SS35110, 35111, 35111.5 , & 35140) ) RESOLUTION OF APPLICATION FOR DANVILLE INCORPORATION The Board of Supervisors of Contra Costa County RESOLVES THAT: It has received a 7-24-81 letter from the "Danville Independence" organization requesting that the County initiate proceedings before the Local Agency Formation Commission (LAFCO) of Contra Costa County for the proposed incorporation of the City of Danville in lieu of the "Danville Independence" organization doing so as petitioners pursuant to Government Code 535110. This Board having considered the request is agreeable to initiating the proposed incorporation only to facilitate and expedite the hearings required but takes no position on the merits of the proposal. This Board hereby applies to LAFCO to initiate the consider- ation of the proposed incorporation of the Danville area as follows: 1. This proposal is made pursuant to the Municipal Organization Act of 1977 (Govt.C.SS35001 ff. ) 2. This proposal is the municipal incorporation of the City of Danville. 3. Exhibit "A" attached hereto sets forth a description of the boundaries of the affected territory and Exhibit "A-1" attached hereto is a map showing such boundaries. 4 . The reasons expressed by "Danville Independence" for the proposed incorporation are the belief that the affected territory should be governed by its elected residents, contains the basic elements for local government (.common identity, needs and interests in governmental participation) , should be directly responsible for the provision and administration of municipal services, and should determine the manner in which it wishes to participate with regional, state and federal jurisdictions. 5. It is requested that proceedings be taken for incorporation pursuant to the Municipal Organization Act of 1977. 6. "Danville Independence" and this resolution propose the name of the "City of Danville" for the new city. 7. It is proposed by "Danville Independence" and this resolution that provisions be made for the appointment of a city manager and the appointment of elective city officials, except City council members. No financial commitment by the County to pay for the cost of an environment impact report (EIR) is intended by this resolution should LAFCO determine that an EIR must be prepared for this RESOLUTION NO. 81/884 r proposed incorporation. Should such an went occur and should "Danville Independence" association refuse to pay for the cost of the ESR , this Board will request the withdrawal of this incorporation proposal from LAFCO. The City of Danville, if formed, is hereby urged to adopt and support the County's 1981 Sycamore Valley Specific Plan. The Clerk of this Board shall file a certified copy of this resolution with the executive officer of LAFCO.
