HomeMy WebLinkAboutRESOLUTIONS - 01011981 - 1981-541 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of ) Establishing the County Land Use ) RESOLUTION NO. 81/541 Regulation Procedures Advisory ) Group } The County Administrator in his April , 1981 report entitled "A Process For Improving County Land Development and Building Permit Procedures ," recommended the establishment of a technically oriented advisory body to the Board of Supervisors and subsequently presented a detailed recommendation on the structure and operation of this advisory body. THEREFORE BE IT BY THE BOARD RESOLVED that the Land Use Regulation Procedures Advisory Group is ESTABLISHED with the follow specifications: A. Name This group will be officially designated as the "Contra Costa County Land Use Regulation Procedures Advisory Group." B. General Purpose The Advisory Group is charged to monitor the formulation of revised administrative procedures in the Public Works , Planning, Building Inspection and Health Services (Environmental Control only) Departments that relate to the review of proposals to develop private property and/or requests for building permits in the unincorporated areas of Contra Costa County and present recommendations . C. Other Duties In addition to the above general purpose, the Advisory Croup is assigned the following additional duties: 1 . Provide technical input on implementing the recommendations of the Internal Operations Committee on County land use regulation procedures. 2. Monitor the effectiveness of these recommendations and report on how well they are accomplishing the objective of improving County processes in this area. D. Philosophical Approach The Advisory Group shall exercise its general purpose and other duties in a collaborative process that gives equal consideration to both public and private objectives in the regulation of land development. The Advisory Group shall serve as an open forum on the technical aspects of the land development procedures of the County and encourage open com- munication between private interests and County staff. It shall actively solicit input from citizens and groups not on the Advisory Group. E. Prohibited Activities 1 . The Advisory Group shall not involve itself in the review of decisions made by the Board of Supervisors, the Planning Commission, or the departments on individual development proposals or requests for building permits. 2. The Advisory Group shall not consider the ongoing and routine management decisions involving personnel , budgetary, or organizational matters that must be made by these agencies. -2- F. Advisory Group Membership and Nomination Appointed in accordance with established Board policy, the following will be the membership of the Advisory Group, 1 . County members: a. The Director of Planning b. The Director of Building Inspection c. The Public Works Director 2. Public members: Six members selected in an attempt to represent the following areas. a. Large residential developers b. Small residential developers c. Commercial and/or industrial developers d. Small general contractors e. Private engineers f. Realtors Following public solicitation of interest in appointment to the Advisory Group, the building industry and real estate associations shall nominate individuals for the public positions. These categories will be used as guide- lines in appointing a technical advisory group that represents all users of the County land use regulation system. The nominations shall be reviewed by the Internal Operations Committee which shall make final recommendations to the full Board of Supervisors . G. Terms Except for the County department heads, all members shall serve terms that expire on dune 30, 1983. H. Public Meetings All meetings of the Advisory Group will be held in accordance with the Ralph M. Brown Act (Government Code 54950 et. seq. ) and will be open to the public. I. Bylaws 1 . Officers. The Advisory Group shall elect a chairperson from among its membership by a majority vote of members present at a meeting attended by a quorum of Advisory Group membership. The chairperson shall preside over all meetings of the Advisory Group. The Advisory Group shall also elect a vice chairperson by the same manner of the chairperson who shall preside over the meeting in the absence of the chairperson. 2. Quorum. A quorum for the purposes of transacting business shall be a majority of the Advisory Group's membership. 3. Alternates. No alternates are permitted. 4. Voting. Issues that must be decided by a vote shall be so decided by a simple majority of those present and voting at a legal meeting. All votes taken by the Advisory Group shall be recorded in the minutes.. RESOLUTION NO. 81/ 541 5, Agenda and Minutes, Each meeting shall have an agenda announcing the time and place of the meeti ng and l is.ti,ng th-e items to b.e. con_ sidered. The agenda will be available for public distri.buti,on for an appropriate period before the meeting. ,Mi.nutes summarizing the items discussed and the actions taken by the Advisory Group shall be issued. 6. Other Rules. The Advisory Group may adopt other rules or procedures as it deems appropriate and shall file a copy of any such rules with the Clerk-of-the-Board. J. Expense Reimbursement Advisory Group members will be entitled to normal and necessary expenses as prescribed in Government Code Section 31000. Travel on Advisory Group business shall be in accordance with established County policy. K. Public Statement by the Advisory Group The Advisory Group shall have the right to take any public position, advocate any action, or present any testimony on matters within its jurisdiction which the Advisory Group or its members deem appropriate, but such actions shall not purport, or be represented, to be the opinions or policies of the County, the Board of Supervisors, individual Super- visors, or any County official or the Advisory Group itself without prior written consent. No individual member shall purport to represent the Advisory Group without prior consent. Public positions taken by the Advisory Group that do not have the endorsement of the Board of Supervisors shall not be published using the County seal or County logo. L. Sunset Clause The Advisory Group is established until June 30, 1983, after which it is officially disbanded unless the Board of Supervisors takes affirma- tive action to continue its operation.
