In the Matter of County Policy
on Road Expenditures in Relation RESOLUTION NO. 81/ 528
to Future City Annexation and
Incorporation Situations
The Board having received a May 5, 1981 report from the Acting Public
Works Director recommendi ng that County Policy on Road Expenditures in Relation
to Future City Annexation and Incorporation Situations be amended; and
The Board having considered the proposed amendment, IT IS BY THE BOARD
RESOLVED that its policy on expenditure of County funds for the construction
of roads in and adjacent to cities shall be in accordance with Board of Su�ervisors
Resolution No. 78/657 (Rescission of the Policy on Aid-to-City Allocations and
79/255 (Frontage Improvement Policy) , subject to modifications listed below:
1 . When a County road contract has been awarded by the Board of
Supervisors and the area involved is annexed to a city or included
in the area of incorporation of a new city subsequent to the
contract award and prior to completion of the work, the contract
road work will be completed at County expense;
2. County agreements to construct paving or other improvements in
particular areas in accordance with the County "Frontage Improve-
ment Policy" shall terminate upon incorporation or annexation of
those areas, as it is set forth in that policy;
3. When an agreement for the Joint Exercise of Powers has been
executed between a City and the County for the joint undertaking
or cost sharing of a project, such agreement shall terminate upon
incorporation or annexation of the area in which all or the major
portion of said project is located unless a contract for the
construction of said project had been awarded prior to incorpora-
tion or annexation.
4. Special City-County agreements may be made under unusual circum-
stances .
IT IS FURTHER RESOLVED that all previous resolutions related to this
matter, including Resolutions No. 68/776, 73/279 and 73/957 , and superseded by
Resolutions No. 78/657 and 79/255 are RESCINDED effective immediately.
