HomeMy WebLinkAboutRESOLUTIONS - 01011981 - 1981-520 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Determination of Property } Tax Exchange - Cutter Ranch} RESOLUTION NO. 81/520 Boundary Reorganization } WHEREAS, the City of Richmond has proposed the Cutter Ranch Boundary Reorganization which involves annexation of territory to the City of Richmond with simultaneous annexation of that territory to the East Bay Municipal Utility District and the West County Sanitary District, and the City will assume the functions of the West County Fare Protection District and the County Library; and. WHEREAS, Revenue and Taxation Code Sections 99 and 99.1 provide for negotiated exchanges of property taxes between agencies; and WHEREAS, in accordance with the above listed code sections the City of Richmond, West Sanitary District, East Bay Municipal Utility District and the County have reached agreement on the exchange of property taxes between the local agencies involved in the Cutter Ranch Boundary Reorganization; NOW, THEREFORE, BE IT RESOLVED that definitions of terms used in this agreement shall be as set forth in the Master Property Tax Exchange Agreement which was adopted by the Contra Costa County Board of Supervisors by Resolution No. 80/1378, adopted December 2, 1980; and BE IT FURTHER RESOLVED that the Board agrees to the trans- fer to the City of Richmond of 100 percent of the Base Tax of the County Library and the West County Fire Protection District previously allocated to the territory being annexed; and BE IT FURTHER RESOLVED that the Board agrees that the calculation of the transfer of Base Tax to the City of Richmond from the County of Contra Costa shall be calculated in accordance with the formulas set forth in the aforementioned Master Property Tax Exchange Agreement; and BE IT FURTHER RESOLVED that for the portion of present Tax Rate Area No. 85111 which is being annexed to the City of Richmond, East Bay Municipal Utility District, and West Contra Costa Sanitary District as a result of the Cutter Ranch Boundary Reorganization, the Board resolves that the Annual Tax lncretdent Allocation Factors shall be as follows: County 17.19583% Co.
