HomeMy WebLinkAboutRESOLUTIONS - 01011981 - 1981-373 RESOLUTION NO« 70 RESOLUTION APPROVING AGREEMENT FOR ENGINEERING SERVICES ASSESSMENT DISTRICT NO. 1980-5 , EL ALAMO IMPROVEMENTS - DANVILLE The Board of Supervisors of the County of Contra Costa resolves: This Board of Supervisors approves that certain agreement between the County of Contra Costa and DeBolt Civil Engineering for services as Engineer of Work for Assess- ment District No. 1980-5, El Alamo Improvements - Danville, Contra Costa County, California, dated the 7th day of April, 1981, which agreement is on file in the office of the County Clerk. The Chairman of the Board of Supervisors is authorized to sign the agreement and the County Clerk is authorized to attest its execution. I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the Board of Supervisors of the County of Contra Costa, State of California, at a regular meeting thereof, held on the 7th day of April, 1981. AGREEMENT FOR ENGINEERING SERVICES ASSESSMENT DISTRICT NO. 1980-5, EL ALAMO IMPROVEMENTS - DANVILLE This is an agreement for engineering services between the COUNTY OF CONTRA COSTA, State of California, referred to as. Client, and DeBOLT CIVIL ENGINEERING, referred to as Engineer. 1. Client retains Engineer as Engineer of Work. for Assessment District No. 1980-5, El Alamo Improvements •- Danville, Contra Costa County, California, to perform the following services: a. Preparation of a map showing the proposed boundaries of the assessment district, in accordance with the requirements of Division 4 .5 of the Streets and Highways Code. b. Preparation of the report required by Section 10204 of the Streets and Highways Code (Municipal Improve- ment Act of 1913) , and modification of the report if directed by the legislative body of Client. The report shall include the following: (1) Plans and specifications for the proposed im- provement. (2) A, general description of improvements to be acquired, -if any, and a legal description of lands, rights--of-way, easements or other interests in real property to be acquired. (3) An estimate of the cost of the improvement, in- cluding the cost of acquisitions and all inci- dental expenses. (4) An assessment diagram showing the parcels of land to be assessed. (OM T� $i�.373 (5) A proposed assessment of the total cost of the improvement on benefited parcels of land with- in the assessment district. C. Compilation of a list of the names and addresses of all owners of land within the assessment district in accordance with records of the County Assessor or in accordance with title reports provided by the Client. d. Posting of notices of improvement on all open streets within the assessment district at distances not greater than 340 feet apart. Copies of notice of im- provement for posting are to be provided by the Client. e. Attendance at meetings of Client' s legislative body, when required by Client' s staff, for the purpose of presenting and seeking approval of the documents and reports described in subparagraphs (a) and (b) . f, Attendance at all other public meetings of Client at which matters relating to the assessment district are considered, except routine matters. g. Attendance at staff meetings or meetings of property owners upon the request of the Client, after reason- able notice. h. Telephone consultation with staff members and property owners to answer engineering questions about the assessment proceedings. 2 . The services of Engineer under this agreement shall not include the following: a. Preparation of an environmental assessment, to determine whether the improvement will have a significant impact on the environment within the meaning of the California Environmental Quality Act. b. Preparation of an Environmental Impact Report if required by Client. -2- C. Inspection of the work of Client' s contractor and certification to the Client of the contractor's entitlement to progress payments. d. Preparation of change orders as may be required during the course of construction. e. Preparation of a final cost schedule after comple- tion of the improvement and payment of all incidental expenses. The performance by Engineer of services excluded by this paragraph, if required by Client, shall be under separate oral or written agreement. 3. In consideration of the services set forth in paragraph 1, Client shall pay to Engineer the sum of $28,386 . 00 when assessment district funds are available. This amount is based on the following breakdown: a. Design of Assessment District Plans : $20, 000. 00 b. Pre-Construction Surveying, which includes establishment of street rights-of-way and obtaining data from the field for design purposes: $5, 000. 00 c. Assessment District Services : $3, 000. 00 d. Blueprinting for bid purposes : 70 sets of plans (6 sheets @ $. 50 per sheet) $210. 00 _3_ �`1�3r3 e. Xeroxing specifications and addendums for bid purposes : (2 ,200 sheets @ $. 08 per sheet) $176. 00 4. All future work, including construction staking, required by Client will be done on a time and materials basis with maximum amount under this agreement being $17, 500. 00 at the following rates: Principal Engineer $60/hour Field Engineer 40/hour Office Engineer 45/hour Researcher -- Office Calculations 34/hour Design Draftsman 25/hour Senior Draftsman 25/hour Junior Draftsman 19/hour Three-man Survey Crew 127/hour Two-man Survey Crew 83/hour Blueprinting . 50/sheet Xeroxing . 08/sheet *Note: Above rates subject to change on July 1, 1981 Taxes and Insurance. Engineer accepts full responsi- bility to pay all taxes and contributions for employees , such as social security, unemployment insurance, etc. Insurance coverage is as follows: Bodily Injury $500, 000/$500,000 Property Damage 500, 000/500, 000 California Workmen' s compensation and Employers Liability Policy -4- Fees to cover taxes and insurance are included in the hourly rates listed above and will not be charged separately. Certificate of insurance policies in effect, accompanied by a statement that all insurance will be kept in force unless advised in writing thirty days prior to cancella- tion, will be provided upon request. 5 . Payment by Client of compensation under this agreement is contingent upon the levy of assessments and the sale and delivery of improvement bonds representing unpaid assessments in the assessment district. If for any reason assessments are not confirmed and bonds not delivered, Engineer shall be paid no fee.
