RESOLUTION OF INTENTION TO ADOPT RESOLUTION OF
NECESSITY
The Board of Supervisors of Contra Costa County RESOLVES THAT:
It intends to adopt a Resolution of Necessity for the acquisition by
eminent domain of real property in the Danville area, for the improvement of Diablo
Road and construction of a bike lane, a public improvement, which property is more
particularly described in Appendix "A", attached hereto.
This Board will meet on April 21 , 1981 at 10:30 a.m. in the Board's
Chamber, County Administration Building, Martinez, California, to hear those persons
whose property is to be acquired and whose name and address appear on the last
equalized County Assessment Roll , and to consider the adoption of the Resolution.
The Real Property Agent is DIRECTED to send the following notice to each such
person by first-class mail :
NOTICE OF INTENTION TO ADOPT RESOLUTION OF NECESSITY
The Board of Supervisors of Contra Costa County DECLARES its intention
to adopt a Resolution of Necessity for the acquisition by eminent domain of real
property in the Danville area, for the improvement of Diablo Road and construction
of a bike lane, a public improvement, which property is more particularly described
in Appendix "A" , attached hereto. The Board will meet on April 21 1981, at 10:30
a.m. , in the Board' s Chamber, 651 Pine Street, Martinez, California, to consider
the adaption of the Resolution. Each person whose property is to be acquired and whose
name and address appear on the last equalized County Assessment Roll , has the right
to appear at such time and be heard on:
1 . Whether the public interest and necessity require
the project.
2. Whether the project is planned and located in the manner
that will be most compatible with the greatest public
good and the least private injury, and
3. Whether the property sought to be acquiredis necessary
for the project.
PASSED BY THE BOARD on March 31 , 1981 , by the following vote:
AYES: Supervisors Fanden, Schroder, McPeak, Torlakson, Powers
NOES: None
ABSENT: None

PARCEL. ONE
A portion of that certain 152.05 acre parcel of land described in
the deed to Laura E. Flourney and Dora Flourney recorded July 17, 1917
in Book 300 of Deeds at page 104, Official Records of Contra Costa
County, State of California, described as follows:
Beginning at the northeasterly corner of the parcel of land described
in the deed to Ronald C. Rocque, et ux, recorded June 10, 1977 in Book
8369 at page 49, Records of said County, thence from said point of
beginning South 00°04'00" East, 25.00 feet to a point on the line
parallel with and 25.00 feet southerly, measured at right angles from
the centerline of Diable Road; thence along said parallel line South
89°56'00" blest, 130.00 feet; thence southwesterly along a tangent
curve to the left, having a radius of 20.00 feet, through a central
angle of 90°00"00", an arc distance of 31 .42 feet to a point on the
easterly line of Via Hermosa, 60.00 feet in width; thence along said
easterly line North 00°04'00" West, 45.00 feet to the northerly line
of said Rocque parcel (8369 OR 49); thence along said northerly line
North 8956`00" East, 150.00 feet to the point of beginning.
Containing a total area of 0.088 acres (3,835 square feet) of land,
more or less, and a net area, exclusive of that portion lying within
the existing county road, of 0.019 acres (836 square feet) of land,
more or less.

to Laura E. Elourney and Dora Elourney recorded July 17, 1917 in Book 300
of Deeds, at page 104, Official Records of Contra Costa County, State of
California, described as follows:
Beginning at a point on the northerly line of said Elourney parcel
(300 D 104) at the easterly line of that certain parcel of land
described in the deed to Margaret A. Bellinger, recorded October 28, 1977
in Book 8569 at page 649, Records of said County; thence from said point
of beginning along said easterly line, South 00°04'00" East, 25.00 feet to
a point on a line parallel with and 25.00 feet southerly, measured at
right angles from the centerline of Diablo Road; thence along said parallel
line South 89"56'00" West, 150.00 feet to the westerly line of said
Bellinger parcel (8569 OR 649) ; thence along said westerly line Borth
00'04'00" West, 25.00 feet to said northerly line of the flourney parcel
(300 D 104) ; thence along said northerly line North 89°56' 00" East,
150.00 feet to the point of beginning.
Containing a total area of 0.086 acres (3,750 square feet) of land, more
or less, and a net area, exclusive of that portion lying within the
existing county road, of 0.017 acres (750 sgaure feet) of land, more
or less.

said northerly line Porth 89°56'00" East, 75.00 feet; thence leaving said
northerly line South 00004'00" East, 25.00 feet to a point on a line
parallel with and 25.00 feet southerly, measured at right angles from the
centerline of Diablo Road; thence along said parallel line South 89056'00"
West, 75.00 feet to said westerly line (9233 OR 1) ; thence along said
westerly line Borth 00004100" West, 25.00 feet to the point of beginning.
