Code 8335) Abandonment No. 1762 The Board of Supervisors of Contra Costa County RESOLVES THAT: A portion of Love Lane, between the Southern Pacific Railroad and Hartz Avenue, in the Danville area, has been superseded by relocation. The relocation portion of Love Lane has been constructed by the San Ramon Unified School District in accordance with County standards and has been accepted by the County. This Board hereby FINDS that the vacation of the superseded portion of Love Lane will not have a significant effect on the environment, and that it has been determined to be categorically exempt (Class 12) in compliance with the California Envfronmental Quality Act. This Board further FINDS that the hereinafter described portion of Love Lane,dedicated to public use, is unnecessary for present or prospective public use and pursuant to the provisions of Chapter 4 of Part 3 of Division 9 of the Streets and Highway Code, it is HEREBY ORDERED VACATED. From and after the date this Resolution is recorded, the highway vacated no longer constitutes a public highway. The Public Works Director shall file with the County Clerk a Notice of Exemption concerning this vacation. DESCRIPTION: See Exhibit "A" attached hereto and incorporated herein by this reference. A portion of that public highway knoum as Love Lane, said Love Lane being described in the quitclaim deed to Contra Costa County recorded July 2, 1946 in Book 922 of Official Records at page 292, Records of Contra Costa County, California, described as follows: Beginning on the northeasterly line of the right of way of the Southern Pacific Company (San Ramon Branch) at the most westerly corner of said County parcel (922 O.R. 292), thence, from said point of beginning along the northwesterly line of said Love Lane (922 O.R. 292), N 5205910011 E 769.07 feet; thence S 3605911411 E 40.00 feet to a point on the southeasterly line of said Love Lane; thence, along said southeasterly line S 5205910011 W 747.64 feet to a point on the said northeasterly line of the right of way of the Southern Pacific Company; thence, along said northeasterly line, N 5205610011 W 41.59 feet to the point of beginning. RESERVING AND EXCEPTING THEREFROM, insofar as such utilities may exist on the date of recording of this vacation, pursuant to the provisions of Section 8340 of the State of California Streets and Highways Code, the easement and right at any time, or from time to time, to coilstl-uct, raintain, operate, replace, remove and renew sanitary se-.;ers and storm drains and appurtenant structures in, upon, over and across a street or high,..,,ay proposed to be vacated and, pursuant to any existing franchise or i-ene,,,als thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles , and other convenient structures, equipment, and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines and for the transportation or distribution of electric energy, petroleum and its products, ammonia, nater, and for incidental purposes, including access to protect such v.,orks from all hazards in, upon and over the area hereinbefore described to be vacated.
