In the Matter of EPA Ban on )
Industrial. Construction } RESOLUTION NO. 81/162
WHEREAS the 1981 County Legislative Program includes support
for enactment of legislation to bring California into compliance with
provisions of the Federal Clean Air Act; and
WHEREAS most Local and state elected officials concur in
support of a vehicle inspection program that will effectively and
efficiently meet the goal of reducing air pollution; and
WHEREAS the Environmental Protection Agency has imposed a
ban on new industrial construction in California because the State
Legislature in its search for the most effective program possible has
not yet enacted a mandatory vehicle inspection program as required by
the Federal Clean Air Act; and
WHEREAS Louisiana. Pacific Company is seeking to replace two
large oil burning boilers with wood burning units which would reduce
pollution emissions and conserve an estimated 500, 000 barrels of oil
per year; and
WHEREAS the Louisiana Pacific Company is unable to proceed
with installation of these boilers at its own expense because of the
Environmental Protection Agency construction ban cited above; and
WHEREAS Congressman Miller has introduced federal legislation
to enable the Louisiana Pacific Company to construct these boilers at
its Antioch plant despite the EPA ban on new industrial construction
in the state; and
WHEREAS the EPA ban on new industrial construction is
adverse to environmental concerns as well as detrimental to the
Louisiana Pacific Company and the economy of Contra Costa County--
directly threatening 450 jobs in a plant that has already lost over
500 jobs in recent years; and
WHEREAS other industries in our own County are planning
plant improvements that would reduce energy consumption and pollution
levels; and
WHEREAS President Reagan has spoken in favor of less
governmental regulation and restriction of private industry and also
of solution to more problems by private enterprise rather than
governmental action;
NOW, "THEREFORE, BE IT RESOLVED that this Board hereby
requests that the Environmental Protection Agency ban on new indus-
trial construction in California be lifted; and
BE IT FURTHER RESOLVED that pending such action that
federal administrative or legislative action be immediately taken
to remove the restriction on issuance of a permit for the Louisiana
Pacific Company boiler replacement project at its Antioch plant.
PASSED AND ADOPTED on February 10, 1981 by the Supervisors
present (Supervisor S. W. McPeak absent) .
