Sec. 8324) The Board of Supervisors of Contra Costa County RESOLVES THAT: On October 9 , 1979 , this Board passed a resolution of intention to vacate the County Highway described in Exhibit "A" attached hereto and incorporated herein by this reference and fixed November 20 , 1979 at 10 : 30 a.m. , in its Chambers , as the time and place for the hearing thereon and ordered that the resolution by published and posted as required by law, which was done as shown by affidavits on file with this Board. The hearing was held at that time and place and as contiuned, this Board hearing and duly considering all evidence offered concerning the vacation by all interested parties. This Board hereby FINDS that the proposed vacation will not have a significant effect on the environment , and that it has been determined to be categorically exempt under State guidelines Section 15112 in compliance with the California Environ- mental Quality Act. The Planning Department having made its general plan report concerning this proposed vacation and this Board having considered the general plan, it finds pursuant to Government Code Sec. 65402 (a) that it has received the report of the Planning Commission' s determination. This Board hereby determines pursuant to Streets and Highways Code Sec. 2381 that the vacation area is not useful as a nonmotorized transportation facility. This Board herefore hereby further FINDS that the hereinabove described proposed vacation area dedicated to public use , is unnecessary for present or prospective use, and it is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibit "A" . The Public Works Director shall file with the County Clerk a Notice of Exemption concerning this vacation. A certified copy of this resolution, attested by the Clerk under seal, shall be recorded in the Office of the County Recorder after the condition indicated in Exhibit A has been satisfied and certified by the Public Works Director. Diablo Blvd. Lafayette, CA 94549 RESOLUTION NO. 81/ 1432 ' VACATION #1906 Pacheco Boulevard EXHIBIT A Portions of the "County Road leading from Martinez to Pacheco", the centerline of which is described in the indenture by and between the Pacific Land Improvement Company and the Atchision, Topeka and Santa Fe Railway Company, recorded April 15, 1904, in Book 105 of Deeds, at page 124, records of Contra Costa County, California, described as follows: Parcel One Beginning on the northerly line of said "County Road" (105 D 124) at the most southerly corner of the parcel of land described in the deed to Siro Sabatini, et ux, recorded December 18, 1955 in Book 2899 of Official Records, at page 400, records of said County; thence, from said point of beginning, along the northerly and northeasterly line of said "County Road" (105 D 124) as follows: North 540 45' 05" east, 5,78 feet, north 860 32' 40" east, 51.46 feet, south 540 57' 20" east, 182.84 feet and south 370 42' 20" east, 43.11 feet to a point of cusp from which a radial line of a non-tangent curve concave to the south, having a radius of 2052.00 feet, bears south 280 26' 07" west; thence, leaving said northeasterly line, westerly along said curved through a central angle of 80 09' 2911, an arc distance of 292.17 feet; thence north 20 16' 38" east, 11.14 feet to the point of beginning. RESERVING AND EXCEPTING THEREFROM, insofar as such utilities may exist on the date of recording of this vacation, pursuant to the provisions of Section 8340 of the State of California Streets and Highways Code, the easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across a street or highway proposed to be vacated and, pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits , cables , wires , poles, and other convenient structures, equipment, and fixtures for the operation of gas pipelines, telegraphic and telephone lines , railroad lines and for the transportation or distribution of electric energy petroleum and its products, ammonia, water and for incidental purposes, including access to protect such works from all hazards in, upon and over the area hereinbefore described to be vacated. Grant Deed the right of way as described below. - 1 - Al VACATION #1806 Pacheco Boulevard EXHIBIT A A portion of the parcel of land described in the deed to General Conveyor, Inc., of Northern California, recorded December 22, 1967 in Book 5522 of Official Records, at page 21, records of Contra Costa County, California, described as follows: Commencing on the centerline of the "County Road leading from ?Martinez to Pacheco", as said centerline is described in the indenture by and between the Pacific Land Improvement Company and the Atchison, Topeka and Santa Fe Railway Company, recorded April 15, 1904, in Book 105 of Deeds, at page 124, records of said County, at the most southerly corner of the parcel of land described in the indenture between the San Francisco and San Joaquin Valley Railway Company and Guiseppi De Martini, et at., recorded November 26, 1898 in Book 81 of Deeds, at page 22, records of said County, from which point a radial Dine of a curve concave to the north, having a radius of 2784.76 feet, bears north 1 12' 11" west; thence from said point of commencement easterly along said curve and southerly line of said De Martini parcel (81 D 22), through a central angle of 00 57' 3911, an arc distance of 46.70 feet to the true point of beginning of the hereinafter described parcel of land, said point being on the northeasterly line of said "County Road" (105 D 124); thence, from said true point of beginning along said northeasterly line as follows. North 460 42' 20" west, 30.44 feet and north 37 42' 20" west, 66.24 feet to a point of cusp from which a radial line of a non-tangent curve concave to the southwest., having a radius of 2042.00 feet, bears south 290 04' 41" west; thence, leavi%9 said northeasterly line, southeasterly along said curve, through a central angle of 3 50" 5911, and arc distance of 137.20 feet to a point on said southerly line of said De Martini parcel (81 D 22) from which point a radial line of a curve concave to the north, having a radius of 2784.76 feet bears north 30 1714211 west; thence, westerly along said curve and southerly line, through a central angle of 10 07' 5211, an arc distance of 54.98 feet to the true point of beginning. Containing an area of 0.054 acres (2,362 square feet) of land, more or less. Bearings and distances used in the above description are based on the California Coordinate System, Zone 111.
