6. RR --+ loyment. Deputy District Attorneys who terminate their
employment with the County in good standing and who are subsequently
re-enplvyed as a Deputy District Attorney within two years from the date of
termination may be appointed at the level at which they were empleyed at
the time of their termination provided that a vacant position exists at
that level. Said appointwnt will be at the first salary step of the
appropriate schedule, unless otherwise provided for by the appointing
authority or designee in which case employees may be appointed up to the
salary step of the level at which they were emplcyed at the time of their
tern ation. If a vacant position does not exist at the level the employee
attained at the time of his/her termination said employee may be appointed
to a lower level position provided that a vacant position exists at that
level.
7. Allocation of Current loyees. Employees encumbering positions in
the classes of Deputy District Attorney III and Deputy District Attorney IV
at the effective date of this resolution shall be allocated to the salary
range of the deep class of Deputy District Attorney as provided below and
in accordance with the attached list of current errplcyees which is
incorporated herein.

8. Definitions and Application of Terms.
(a) Reassignment means the movement from one work level to another
Within the deep class or from are work level position to another
work level position within the deep class.
(b) Prcwtion, Demotion, and Transfer - For the purposes of prcxw4on,
demotion and transfer to and from the deep class of Deputy District
Attorney, salary refers to and shall be based on the salary
established for each of the levels within the whole deep
classification rather than on the bottcm and top salary steps of
the whole deep class.
9. Anniversary Dates.
(a) Current Permanent "aplayees. The anniversary date of an employee
having permanent status in one of the aforementioned
classifications listed in Paragraph 7 at the effective date of this
resolution shall remain unchanged.
(b) Current Probaticnary and New Srm1c s. The anniversary date of an
employee having probationary status in one of the aforementioned
classifications as of the effective date of this resolution and all
new emplayees appointed at the first salary step shall be the first
day of the calendar month after the calendar moth when he/she
successfully c mpletes six mmths full time service, except that
when he/she began work on the first regularly scheduled workday of
the nmth for his/her position which was not the first calendar clay
that moth, the anniversary is the first day of the calendar month
when he/she successfully ompletes six months full time service.
(c) Reassignment to Higher level Position. The anniversary date: of a
Deputy District Attorney who is assigned to a specialized
assignment level position is determined as for a new employee in
(b) above.

placed at the level and salary step he/she was at prior to being promoted.
14. Sal - On Volum Demotion. Notwithstanding Section 13 above,
whenever any employee voluntarily demotes to Deputy District Attorney at a
level which has a salary schedule lzwer than the class from which the
employee is demoting, his/her salary shall remain the same if the steps in
the new (derated) salary schedule permits, and if not, his/her new salary
shall be set at the step next below his/her forms' salary.
15. Salary - On Transfer. Whenever a permanent employee moves to a Duty
District Attorney position at a work level, the salary schedule of which is
allocated to the same salary ranee as is the class of the position which
the employee previously occupied, the employee shall continue to be
compensated at the sane step of the salary schedule to which the classes
are allocated.
16. Salary on Re-assignment From a S�eci$lized Assic nt Position to an
Rg rienced bevel Position. An enployee who is reassigned from a
specialized assigrzrent level position to a position at the experienced
level shall be planed on that step of salary schedule A which he/she would
have achieved had he/she remained continuously in the experienced level
position to which he/she has been reassigned.
17. Re-classification of Position. The salary of an employee whose
position is reclassified frau a class on the basic salary schedule to the
Deputy District Attorney classification shall be established in accordance
with the applicable :sections of this resolution. An employee's salary who
is in a position that is re-classified foam Deputy District Attorney to
another class on the basic salary schedule shall be determined based upon
the Deputy District Attorney salary schedule for his/her level and the
provisions of Resolution 81/581 or other applicable deep class resolutions
or ordinances.
18. Seniority. An employee's seniority for layoff and displacement
purposes i.n the "deep class" of Deputy District Attorney shall be
determined by adding (a) his/her length of service in other classes at the
same or higher salary levels as determined by the salary schedule in effect
at the time of layoff and by adding (b) his/her length of service in the
classes of Deputy District Attorney III and IV to other service described
in (a) above. Service for layoff and displacement purposes includes only
the ,employee's last continuous permanent County employmsant.
Other rules affecting seniority are contained in the Rules and Regulations
of the County Civil Service Cc mission.
19. Other Provisions. The provisions of Resolution 81/581 are applicable
except those provisions which have been modified by this resolution or
those provisions which hereinafter may be modified by resolutions.
PASSED and ADOPTED on December 1 , 1881 by the following vote of the Board;
AYES: Supervisors Fanden, Schroder, McPeak, Torlakson, and Powers.
NOES: None.
