HomeMy WebLinkAboutRESOLUTIONS - 01011981 - 1981-1349 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of ) Revised Fee Policy for ) Segregation of Assessments ) RESOLUTION NO. 81/ 1349 1915 Improvement Bond Act ) ) On August 26, 1969, this F-a—r-d by Resolution 69/567 having established a fee of $160.00 for segregation of assessments levied in accordance with the Improvement Bond Act of 1915; and The Public Works Director having recommended in a report to the Board that its policy regarding costs and fees to be collected for Segregation of Assessments, established in accordance with the Improvement Bond Act of 1915, be revised; and The Public Works Director having noted in the aforementioned report that: 1. Section 8730 of the Streets and Highways Code requires that costs and fees for the segregation of assessments be fixed by the Board at the time of ordering the segregation of assessment. 2. The present fee of $160.00 for Segregation of Assessments as established by Board Resolution 69/567 (August 26, 1969) is not adequate to cover the present personnel , material and mailing costs involved. 3. Present costs of segregation of assessments are about $250 per original affected parcel plus $10 per division of said parcel . 4. Section 8740 of the Streets and Highways Code provides that a fee be fixed by the Board for owner initiated apportionment of assessment. The Board has not previously fixed the fee. 5. Segregations by the procedure in Section 8740 of the Streets and Highways Code are less costly being about $200 plus $10 per division of the original affected parcel. NOW, THEREFORE, BE IT RESOLVED that, effective immediately, the policy established by Board Resolution 69/567 passed on August 26, 1969, is superseded and the Policy for determining costs and fees to be collected for segregation of assessments pursuant to Section 8730 of the Streets and Highways Code shall be as follows: Whenever this Board authorizes segregation of assessments pursuant to Section 8730 of the Streets and Highways Code, the costs and fees to be collected will be equal to $250 per affected parcel , plus $10 per division of said parcel. BE IT FURTHER RESOLVED that the fee for owner initiated Segregations pursuant to Section 8740 of the Streets and Highways Code shall be equal to $200 plus $10 per division.
