Cade Sec. 8320 & 8321 The Board of Supervisors of Contra Costa County RESOLVES THAT: Pursuant to Chapter 3, "General Vacation Procedure," of Part 3 of Division 9 of the Streets and Highways Code, this Board declares its intention to vacate the hereinafter described County Highway. For a description of the portion to be vacated, see Exhibit "A" attached hereto and incorporated herein by this reference. This proposed vacation is generally located in the area of Orinda. A map of the portion to be vacated is on file in the Public Works Department. It fixes December 22, 1981., ,10:30 a.m.. in its Chambers, Administr tion Building, 651 Pine Street, Martinez, California, as the time and place for earing evidence offered by any interested party as to whether this is unnecessary for present or prospective public use. The Clerk shall have notice of this matter published in the Contra Costa Sun, a newspaper of general circulation published and circulated in this County, which is selected as the newspaper most likely to give notice to persons interested in the proposed vacation, for at least two successive weeks before the hearing in accordance with Streets and Highways Code, Section 8322. The Clerk shall also have said notice posted conspicuously along a line of this proposed vacation at least two weeks before the hearing, in accordance with Streets and Highways Code, Section 8323. Naylor 33 Normandy Lane Orinda, CA 94563 Resolution No. 81/1266 i 3k. x VACATION 1887 BEARINDA LANE, ORINDA EXHIBIT A A portion of the Rancho Boca de La Canada del Pinole, Centra Costa County, California, being a portion of Bear Creek Road as shown on the map of Sub- division MS 118-76, recorded January 26, 1977 in Book 51 of Parcel Maps at page 39 Records of Said County being described in the deed to Contra Costa County Recorded February 3, 1967 in Book 5299 at page 314. Official Records of said county lying westerly and northerly of the following described line. Beginning at the true point of beginning as described in said deed (5299 0. R. 314) ; thence along the westerly line and its southerly prolongation of Bear Creek Road south 9° 19' 09" east 719.98 feet; thence, leaving said southerly prolongation, south 69° 46' 30" west 1.09.46 feet to a point on the westerly line of Beal: Creek Road which shall herein after be referred to as point "A'", said westerly line being described as "north 0° 10' 57" west 70.77 feet" in said deed (5299 O.R. 314) ; said point "A" bears north 0° 10' 57" west 26.00 feet from the southerly terminus of said westerly line; thence leaving said point "A" along the westerly prolongation of the last course south 691 46' 30" west 96.79 feet to a point on the westerly line of said Subdivision MS 118-76 (51 P.M. 39) . RESERVING AND EXCEPTING THEREFROM, insofar as such utilities inay exist on the date of recording of this vacation, pursuant to the provisions of Section 8340 of the State of California Streets and Highways Code, the easement and right at any time, or from time to time , to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across a street or highway proposed to be vacated and, pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables , wires , poles, and other convenient structures , equipment, and fixtures for the operation of gas pipelines, telegraphic and telephone lines , railroad lines and for the transportation or distribution of electric energy petroleum and its products, ammonia, water and for incidental purposes, including access to protect such works from all hazards in, upon and over the area hereinbefore described to be vacated.
