HomeMy WebLinkAboutRESOLUTIONS - 01011981 - 1981-1262 i BEFORE THE BOARD OF SUPERVISORS OF COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA In the Matter of the Proposed } Abatement of the Property of } } RESOLUTION NO. 81/1262 Samuel Perkins } WHEREAS it appears from the records of this Board that the Contra Costa County Building Inspector , acting in accordance with the Uniform Building Code , 1979 Edition, Sec. 203 " Uniform Housing Code, 1979 Edition, Sec. 1001 and Title 25 , Chapter 1, Subchapter 1, Sec. 114 et seq. of the California Administrative Code, having determined that the building (s) and/ or improvement {s} located at 513 Grove St. , Richmond , CA is substandard and is therefore a public nuisance; and said Building Inspec- tor having pasted said property with Notice of Substandard Building and having notified the owner of said property that it is substandard in the manner provided by law as appears more particularly from the declaration of the Building Inspector on file herein; and WHEREAS the said building and/or improvements have not been re- paired or removed as required by said Notice of Substandard Building , and WHEREAS said Building Inspector thereafter posted said property with Notice to Abate Nuisance, which notice specified the time and place of the hearing before this Board for the owners of said property to show cause why the building and/or improvements thereon should not be condemned as a public nuisance, and the Building Inspector having notified the owners of said property of said hearing in the manner provided by law; and WHEREAS the matter having come on for hearing by this Board on Tuesday, Oct. 20 , 1981 , at 10 :30 a.m. as provided in the notice herein- above mentioned; and WHEREAS the owner of said property having appeared and agreed to work out a rehabilitation agreement or abatement schedule with the Building Department and WHEREAS Mr . Martindale recommended that the Board continue the hearing for two weeks to work out such agreement, and the Beard having considered the matter and continued the hearing to Tuesday, Nov. 3 , 1981 at 10 :30 a.m. and , WHEREAS the Board having considered the evidence presented by said Building Inspector and all other interested parties, the following appears and, this Board now finds that said building and/or improvements wire substandard as defined in Section 1001 of the Uniform Housing Code , 1979 Edition. BE IT THEREFORE RESOLVED that said building and/or improvements are substandard and are declared to be a public nuisance and the owners thereof are hereby ordered to abate said nuisance after a copy. of this resolution, together with notice thereof, has been posted to said property. Parcel No: 409 -142--011 Page 1 of 2 Res. # 81/1252 i ♦ ' BE IT FURTHER RESOLVED that it is the conclusion of the Board that said building and/or improvements cannot be reconstructed or re- paired in a manner so as to comply with the provisions of Title 25 , Chapter 1, Subchapter 1 of the California Administrative Code or the Uniform Housing Code , 1979 Edition, as incorporated in the Contra Costa t;caLMLy Ui:dinzincc Cade and therej-01'C !;aid 1,uilditicj and/car improvements must be razed and removed. IT IS FURTHER ORDERED that if said nuisance is not abated with- in the time allowed , said nuisance will be abated by the Building Inspec- tor of the county in accordance with the provisions of Title 25 , Chapter 1, Subchapter 1 of the California Administrative Code , and the expense there- of may be made a lien upon the land upon which said building and/or improve- ments are located , PASSED AND ADOPTED ON November 3 , 1981 by the following vote : AYES : Supervisors Fanden, Schroder , Torlakson, Mc Peak NOES: Supervisor Powers ABSENT• None i hereby eertf€y that this is a true and correct cagy of an action taken and enfcred or the M1,07ut" of the Board of 8upsrr ISM or?tit3 es.e eiown.
