Resolution of Summary Vacation Highway

The Board of Supervisors of Contra Costa County RESOLVES THAT:
This vacation is made pursuant to Streets and Highways Code Section 8330.
The subject right of way has been in use as a parking lot for the Orinda Community
Church. This road has been serving only local traffic for the church and for
library deliveries and has no significance from the viewpoint of areawide
circulation. This vacation will serve to limit access to the Housing Project
for the Elderly planned on the church property. This project is located in
an area designated as Public and Semipublic on the Orinda Area General Plan.
For a description of the portion to be vacated, see Exhibit "A" attached hereto
and incorporated herein by this reference.
This Board hereby FINDS that the proposed vacation will not have a
significant effect on the environment, and that it has been determined to be
categorically exempt under State guidelines Section 15112 in compliance with the
California Environmental Quality Act. This vacation is not located in an area
of statewide interest or in any potential area of critical concern.
The Planning Department having made its general plan report concerning
this proposed vacation and this Board having considered the general plan, it
finds pursuant to Government Code §65402(a) that it has received the report of
the Planning Commission's determination.
This Board declares that the hereinabove described proposed vacation
area is HEREBY ORDERED VACATED subject to any reservation and exception and
conditions described in the attached Exhibit "A". From and after the date this
Resolution is recorded, the portion vacated no longer constitutes a highway. This
vacation is made under the Streets and Highways Code, Chapter 4, Sections 8330
et seq. This right of way lies within the property of the Orinda Community
Church, a single ownership, and does not continue through this ownership or end
touching another property.
The Public Works Director shall file with the County Clerk a Notice of
Exemption concerning this vacation.
In accordance with Section 8324 of the Streets and Highway Code, a
certified copy of this resolution, attested by the Clerk under seal , shall be
recorded in the Office of the County Recorder after the conditions described in
Exhibit "A" have been met as determined by the Public Works Director,

EXHIBIT A
A portion of Irwin Way as said road is described in the deed to Contra
Costa County recorded December 28, 1950 in Book 1693 of Official Records,
at page 6, Records of Contra Costa County, California, described as
follows:
Commencing at Point "A" as said point is described in Parcel A of said
deed to Contra Costa County (1693 OR 6); thence from said Point "A" ,
North 460 041 00" East, 20.00 feet to the true point of beginning;
thence from said true point of beginning, South 43' 561 00" East, 55.28
feet; thence southeasterly along a tangent curve concave to the north-
east having a radius of 20.00 feet, through a central angle of 48* 1 ] '
2511, an arc distance of 16.82 feet to a point from which a radial line
of a reverse curve concave to northwest having a radius of 40.00 feet
bears South 2' 071 25" East; thence southeasterly, southwesterly and
northwesterly along said reverse curve through a central angle of 276*
22' 50" an arc distance of 192.95 feet to a point from which a radial
line of a reverse curve concave to the west having I a radius of 20.00
feet bears North 85* 441 35" West; thence northerly along last said
reverse curve, through a central angle of 48' ) 1 ' 25", an arc distance
at 16.82 feet; thence tangent to said curve, North 43* 561 00" West,
55.28 feet; thence northwesterly along a tangent curve concave to the
southwest having a radius of 107.00 feet, through a central angle 44*
151 0111, an arc distance of 82.64 feet; thence along the prolongation
of the radial line at the end of said curve, North 1* 48' 59" East,
40.00 feet to a point on a concentric curve concave to the south-
west having a radius of 147.00 feet; thence southeasterly along said
curve, through a central angle of 44* 15' 0111, an arc distance of
113.53 feet to the true point of beginning.
Contain!'ng an area of 1i ,446 square feet or 0.263 acres of land more
or less.
RESERVING AND EXCEPTING THEREFROM, insofar as such utilities may exist
on the date of recording of this vacation, pursuant to the provisions
of Section 8340 of the State of California Streets and Highways Code,
the easement and right at any time, or from time to time, to construct,
maintain, operate, replace, remove and renew sanitary sewers and storm
drains and appurtenant structures in, upon, over and across a street
or highway proposed to be vacated and, pursuant to any existing franchise
or renewals thereof, or otherwise, to construct, maintain, operate,
replace, remove, renew and enla'rge lines of pipe, conduits, cables, wires,
poles, and other convenient structures, equipment, and fixtures for the
operation of gas pipelines, telegraphic and telephone lines, railroad
lines and for the transportation or distribution of electric energy,
petroleum and its products, ammonia, water, and for incidental purposes,
including access to protect such works from all hazards in, upon and
over the area hereinbefore described to be vacated.
