Incorporation Reorganization (Gov.C. 556430)

The Board of Supervisors of the County of Contra Costa resolves
that:
On March 20, 1981 the Kensington Community Services District
filed resolution of application for the proposed Reorganization
with the Executive Officer of the Local Agency Formation Commis-
sion of Contra Costa County.
The reason for the proposed Reorganization is to provide
local control and self-determination in governmental matters
affecting the territory of the Reorganization, while increasing
efficiency and reducing the costs of providing governmental
services.
The following are the changes of oraanization comprising the
subject Reorganization:
1) Incorporation of a new city, to be named the "City of
Kensington" ;
2) Establishment of the Kensington Community Services
District as a subsidiary district of the City of Kensington;
3) Establishment of the Kensington Fire Protection District
as a subsidiary district of the City of Kensington;
4) Dissolution of County Service Area L32 (street lighting) ;
5) Annexation to Kensington Community Services District of
all territory that is to be within the city' s boundaries but is
not within the boundaries of the Community Services District;
6) Annexation to the Kensington Fire Protection District of
all territory that is to be within the city' s boundaries but is
not within the boundaries of the Fire Protection District.
All of the foregoing changes of organization concern districts
or territories entirely within the County of Contra Costa.
The terms and conditions of the proposed Reorganization are
as follows :
1) The effective date of the Reorganization shall be July 1,
1982 and each of the changes of organization shall occur simul-
taneously with the Reorganization becoming effective. Upon the
Reorganization becoming effective, pursuant to law the City Council
of the City of Kensington shall become, and be empowered to act
as, ex officio the Board of Directors both of Kensington Community
Services District and of Kensington Fire Protection District.

2) The City of Kensington is designated as the successor to
County Service Area L-32 pursuant to Government Code Section 56470 (m) .
3) The only elected officers for the City of Kensington shall
be the members of the City Council as provided by Government Code
Section 36511.
4) The Board of Supervisors shall submit an additional ballot
measure at the election called for the voters to approve
Pprove or dis-
approve this Reorganization, for the purpose of establishing an
appropriation limit for the proposed City of Kensington pursuant to
Article XIIIB of the California State Constitution. The amount of
such appropriation limit shall be sufficient to enable the City to
finance services within its jurisdiction other than services to be
provided by Kensington Community Services District (police Protec-
tion, and recreation and park service) and Kensington Fire Protection
District as subsidiary districts of the City. The Commission' s
approval of this Reorganization proposal is subject to the condition
that the appropriation limit ballot measure be approved by the
voters.
On September 10, 1981, the Local Agency Formation Commission
approved the Reorganization, with the changes of organization,
terms and conditions set forth above. The boundaries of the pro-
posed Reorganization territory are as set forth in the Resolution
of the Local Agency Formation Commission of Contra Costa County,
approving the Reorganization, a copy of which is on file and
available for public inspection in the office of the Clerk of the
Board of Supervisors, 651 Pine Street, Martinez , CA.
On Tuesday, November 17, 1981 at 10: 30 a.m. in the Board of
Supervisors' chambers, County Administration Building, 651 Pine
Street, Martinez, California this Board will hold a hearing on
the proposed Reorganization. Any interested person desiring to
protest the proposed Reorganization shall do so by filing written
Protest with the Clerk of the County not later than the time set
for the hearing. If the protest is by a landowner, it shall contain
a description sufficient to identify the land owned by him. If
the protest is by a voter, it shall contain the residential address
of the voter.
The Clerk of this Board shall give notice of this resolution
pursuant to Government Code §§56087-9, 56083 & 4 and 56085 & 6.

ORDINANCE NO. 81- 77
(Repealing Division 34 , Employer-Employee Relations)
The Contra Costa County Board of Supervisors ordains as follows:
SECTION I. Repeal of Division 34 . So that terms and
conditions of employment can be determined by Board Resolution,
Division 34 of the County Ordinance Code, on Employer-Employee
Relations, comprizing Chapters 34-2 on General Provisions,
34-4 on Definitions, 34-6 on Employee Rights, 34-8 on County
Rights and Representatives, 36-10 on informal Recognition
Procedure, 34-12 on Formal Recognition Procedure, 34-14 on
Representation Process, 34-16 on Impass Procedures, 36-18 on
Employees Meeting on County Time, 34-20 on Use of County
Facilities, 34-22 on Unfair Practices, 34-24 on Sanctions,
34-26 on Dues Deduction, and 34-28 on Grievance Procedure,
is hereby repealed.
SECTION II. Ordinance Implements Memoranda of Understanding.
This ordinance specifically relates to, and is necessary to
implement, certain provisions of memoranda of understanding
between recognized employee organizations and the County, and
pursuant to Government Code 525123(e) (Stats. 1981, Chap. 141,
SB-182) is to become effective immediately upon adoption.
SECTION III. Immediate Effective Date. As stated in
Section II, this ordinance becomes effective immediately upon r
passage, and within 15 days of passage shall be published once
with the names of Supervisors voting for and against it in the
MARTINEZ NEWS-GAZETTE , a newspaper published in this County.

NOES: Supervisors: None.
ABSENT: Supervisors None.
