IN THE BOARD OF SUPERVISORS OF
CONTRA COSTA COUNTY, STATE OF CALIFORNIA
A RESOLUTION OVERRULING PROTESTS AND DETERMINING
THAT THE BOARD OF DIRECTORS OF CONTRA COSTA COUNTY
SANITATION DISTRICT NO. 15 HAS JURISDICTION TO
PROCEED WITH THE ISSUANCE AND SALE OF
SEWER REVENUE BONDS

RESOLUTION NO. 81/1117
RESOLVED, by the Board of Supervisors of Contra Costa County,
Martinez, California, as ex officio Board of Directors of Contra Costa
County Sanitation District No. 15 (herein called "CSD No. 150) as
follows:
WHEREAS, on August 25, 1981, the Board of Directors of CSD
No. 15 adopted its Resolution No. 81-992, A Resolution of Intention to
Acquire and Construct works Consisting of Improvements to Wastewater
Treatment and Disposal Facilities and Appurtenances and To Issue and
Sell Sewer Revenue Bonds to Finance the Cost Thereof, all as more
particularly described therein, tixing Tuesday, the 29th day of
September, 1981, at the hour of 10 :30 o' clock A.M. , in the public
meeting room of the Board of Supervisors, Martinez, California, as the
time and place when and where persons interested might appear before
the Board of Directors and be heard as to any protests or objections
they might have against the acquisition or construction of the proposed
works and the issuance and sale of revenue bonds therefor;
WHEREAS, copies of said resolution were published twice in the
Antioch Daily Ledger, in the Brentwood News and in the Bethel Island
Beacon, newspapers published and circulated in CSD No. 15, the second
of which publications were at least ten (10) days before the time set
for hearing;
WHEREAS, copies of said resolution, headed "Notice of Sewer work"
in letters not less than one inch in height, have been posted at least
ten (10) days before the time set for hearing at least 300 feet in
distance apart, and not less than three in all, along Bethel Island
Road, .for its entire .length within the boundaries of CSD No. 15 said
street being, in the opinion of the Board of Directors, the street in
said District traversed by the largest number of people;
WHEREAS, copies of a Notice of Public Hearing were mailed
pursuant to Section 53520 and following of the Government Code, postage
prepaid, to all persons owning real property which will be within the
area proposed to be served by the works, whose names and addressees
appear on the last equalized County assessment roll (including the roll
of State-assessed property) or are known to the Clerk of the District,
at least fifteen (15) days prior to the date fixed for hearing;

WHEREAS, proofs of publication and certificates of posting and
mailing of said resolution and notice are on file in the office of said
Clerk;
WHEREAS, plans and specifications for said work and improvements
prepared by the Engineers chosen therefor to prepare same, which were
and are on file with the Engineer ex officio, were referred to in said
Resolution of Intention; and
WHEREAS, all persons interested, or their representatives,
having any objections to the acquisition or construction of the
proposed works or the issuance and sale of bonds, or any suggestions in
the way of an amendment or modification of the proposition, and all
interested persons desiring to be heard were given an opportunity to be
heard, and all matters and things pertaining to said project and said
proceedings were fully heard and considered by said Board;
NOW, THEREFORE, this Board does hereby FIND, DETERMINE and ORDER
as follows:
1. That all objections to the acquisition or construction of
the proposed works and the issuance and sale of revenue bonds and all
suggestions offered in the way of an amendment or modification of the
proposition have been duly considered by this Board and are hereby
overruled.
2. That before the conclusion of the hearing , a petition was
not filed with this Board, signed either by not less than 158 of the
owners within the area to be served by the proposed works, all as
described in said Resolution of Intention, or by not less than 15% of
the registered voters within said area, requesting that the Board
submit the proposition of acquiring or constructing the proposed works
to an election of the registered voters in said area.
3. That this Board has acquired jurisdiction to proceed
pursuant to Chapter 5, Part 3, of Division 5 (commencing with Section
4950) of the Health and Safety Code, commonly referred to as the Sewer
Revenue Bond Act of 1933, with the acquisition and construction of the
proposed works and the issuance and sale of revenue bonds therefor.
PASSED by the Board on _September 29 , 1981 by the following
vote:
AYES: Supervisors Fanden, McPeak, Torlakson and Powers
