Code 956.8 ?. 8321 The Board of Supervisors of Contra Costa County RESOLVES THAT. Pursuant to the Streets and Highways Code, it declares its intention to vacate the hereinafter described County Road. It fixes Tuesday, March 10, 1981 at 10:30 a.m. (or as continued) in its Chambers, Administration Building, 651 Pine Street, Martinez, California, as the time and place for hearing evidence offered by any interested party as to whether this road is unnecessary for present or prospective public use. This matter is referred to the Contra Costa County Planning Commission for report before the hearing. The County Clerk shall have notice of this matter (1 ) published in the Martinez News Gazette, a newspaper of general circulation published in this County which is designated as the newspaper most likely to give notice to persons interested in the proposed vacation , for at least two successive weeks before the hearing and (2) posted conspicuously along the line of this road at least two weeks before the hearing.. DESCRIPTION: See Exhibit "A" attached hereto and incorporated herein by this reference. Public Works Accounting RESOLUTION NO. 81/111 EXHIBIT "All First Avenue Road No. 3975E ROAD ABANDONMENT #1859 Portion of the "Hawxhurst Addition - Survey 1863 and Town of Pacheco" which map was filed in Volume E of Maps, at page 95, Official Records of Contra Costa County, State of California, described as follows: All that portion of First Avenue (formerly Center Street) lying easterly of Blackwood Drive (formerly A Street) as said streets are shown on said map of the Hawxhurst Addition (EM 95) and westerly of the strip of land, 170 feet in width, lying between "Point L" and "Point M" as said strip is described on page 2 of Exhibit "A" attached to the Lis Pendens, entitled "Contra Costa County Flood Control and Water Conservation District vs V. P. Baker, et al " Superior Court Case No. 85414, recorded May 8, 1962 in Book 4114, at page 761 , of Official Records of said County. RESERVING AND EXCEPTING THEREFROM, pursuant to the provisions of Section 959.1 of the Streets and Highways Code, the easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any highway or part thereof proposed to be abandoned and pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe , conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and for incidental purposes including access to protect the property from all hazards in, upon and over the area hereinbefore described to be abandoned.
