HomeMy WebLinkAboutRESOLUTIONS - 01011981 - 1981-1079 BEFORE THE BOARD OF SUPERVISORS OF COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA In the Matter of the Proposed RESOLUTION NO: 81/1079 Abatement of the Property of HenryBerry WHEREAS it appears from the records of this Board that the Contra Costa County Building Inspector , acting in accordance with the Uniform Building Code 1979 Edition Sec. 203 and Uniform Housing Code 1979 Edition , Sec . 1-001 and Title 25 , Chapter 1 Subchapter 1 Sec. 1012 et seq. of the California Admin- istrative Code, having determined that the building (s) and improve- ments located at 42 Chesley, N. Richmond , CA Parcel No: 409-041-007 are substandard and are therefore a public nuisance; and said Build- ing inspector having posted said property with Notice of Substandard Bui._IgLin% and having attempted to notify the owner of said property that it is substandard in the manner provided by law as appears more particularly from the declaration of the Building Inspector on file herein; and WHEREAS the said buildings and improvements have not been repaired or removed as required by said Notice of Substandard Build- ings and improvements , and WHEREAS said Building Inspector thereafter posted said property with Notice to Abate Nuisance , which notice specified the time and place of the hearing before this Board for the owners of said property to show cause why the buildings and improvements thereon should not be condemned as a public nuisance, and the Building Inspector having notified the owners of said property of said hearing in the manner provided by law; and WHEREAS the matter having come on for hearing by this Board on Tuesday, SeptembeL , _22 1 at 10 : 30 A.M. _ 8�� as provided in the notice hereinabove mentioned; and WHEREAS the Board having considered the evidence presented by said Building Inspector and all other interested parties, the following appears and this Board now finds that said building (s) and improvements are sub-standard as defined in Sections 1001 and 1002 of the Uniform Housing Code , 1979 Edition. Page 1 of 2 RESOLUTION NO. 81/1079 BE IT THEREFORE RESOLVED that said buildings and improve- ments are substandard and are declared to be a public nuisance and the owners thereof hereby ordered to abate said nuisance within 30 days after a copy of this resolution , together with notice there- of , has been posted to said property. BE IT FURTHER RESOLVED that it is the conclusion of the Board that said buildings and improvements cannot be reconstructed or repaired in a manner so as to comply with the provisions of Title 25 Chapter 1 Subchapter 1 of the California Administrative Code or the Uniform Housing Code , 1979 Edition as incorporated in the Contra Costa County Ordinance Code and therefore said buildings and improvements must be razed and removed. IT IS FURTHER ORDERED that if said nuisance is not abated within the time allowed , said nuisance shall be abated by the Build- ing Inspector of the County, and the expense thereof is to be paid out of Community Development Block Grant Funds under the Operation Clean—Up Program.
