Section 1245.235 Morello Avenue Safetv Path Project No. 0662-6S4186 } Martinez Area } RESOLUTION OF INTENTION TO ADOPT RESOLUTION OF NECESSITY , The Board of Supervisors of Contra Costa County RESOLVES THAT: It intends to adopt a Resolution of Necessity for the acquisition by eminent domain of real property in the Martinez area, for the improvement of Morello Avenue and construction of a bike path, a. public improvement, which property is more particularly described in Appendix "A" , attached hereto. This Board will meet on October 13, 1981 at 10:30 a.m. in the Board's Chambers, County Administration Building, Martinez, California, to hear those persons whose property is to be acquired and whose name and address appear on the last equalized County Assessment Roll , and to consider the adoption of the Resolution. The Real Property Agent is DIRECTED to send the following notice to each such person by first-class mail : NOTICE OF INTENTION TO ADOPT RESOLUTION OF NECESSITY The Board of Supervisors of Contra Costa County DECLARES its intention to adopt a Resolution of Necessity for the acquisition by eminent domain of real property in the Martinez area, for the improvement of Morello Avenue and construction of a bike path, a public improvement, which property is more particularly described in Appendix "A", attached hereto. The Board will meet on October 13, 1981 , at 10:30 a.m. , in the Board' s Chambers, 651 Pine Street, County Administration Building, Martinez, California, to consider the adoption of the Resolution. Each person whose property is to be acquired and whose name and address appear on the last equalized County Assessment Roll , has the right to appear at such time and be heard on: 1 . Whether the public interest and necessity require the project. 2. Whether the project is planned and located in the manner that will be most compatible with the greatest public good and the least private injury; and 3. Whether the property sought to be acquired is necessary for the project. P � 1981 drt � 4 i»1 cc: County Administrator County Counsel Public Works Accounting (Via R/P) Property Owners (via R/P) RESOLUTION NO. 81/ 1077 I3� APPENDIX "A" MORELLO AVENUE SAFETY PATH That parcel of land in the unincorporated area of the County of Contra Costa, State of California, described as follows: Portion of Lots "C" and "D" , as designated on the map entitled "Plat of the Partition of the John Kelly Estate", which map was filed in the Office of the Recorder of the County of Contra Costa, State of California on June 14, 1873 in Volume 25 of Deeds, at page 1 , described as follows: Beginning on the east line of said Lot "C" at the northeast corner of the 1 acre parcel of land described in the deed from Gertrude J. Gale, to H. P. Hoesly, dated May 1 , 1925 and recorded May 5, 1925 in Volume 491 of Deeds, at page 195; thence, from said Point of Beginning North 0*23' 34" East, 591.33 feet and North 0°32`50" East, 27.11 feet along said east line to the southeast corner of the 22 acre parcel of land described in the deed from John Kelly, et ux, to Antone Maderos, Jr. dated November 1 , 1924 and recorded November 5, 1924 in Volume 478 of Deeds, at page 291 ; thence, West along the south line of said Maderos parcel (478 D 291 ) , 10.07 feet; thence, South 0°23' 34" West, 618.31 feet to the north line of said Hoesly parcel (491 D 195); thence, South 89014105" East along the north line of said Hoesly parcel , 10.00 feet to the Point of Beginning.
