HomeMy WebLinkAboutRESOLUTIONS - 01011981 - 1981-1070 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of ) Terminating Temporary } RESOLUTION N0. 81/1070 Off-Tract Drainage ) Easement Subdivision 5011 } Oakley Area ) WHEREAS, on September 21, 1970, Leinke Construction Co. , Inc. , then owner of Subdivision 5011, situated in Contra Costa County, offered to dedicate to the County of Contra Costa a strip of land described in Exhibit A attached hereto and made a part hereof to be used as a temporary storm drainage easement; and WHEREAS, on October 9, 1979, the Board of Supervisors accepted said parcel of land, which acceptance was recorded in the Office of the County Recorder, Contra Costa County, on October 12, 1979, in Book 9574, Page 291 and which acceptance provided as follows: "In the event CONTRA COSTA COUNTY, or its successors or assigns should determine that the use of said property or any portion thereof is no longer needed, the rights herein given shall terminate as to those portions not needed and revert to the undersigned owners or their successors or assigns"; and WHEREAS, Lemke Construction Co. , Inc. sold said Subdivision 5011 to the Albert D. Seeno Construction Co. {Seeno} on September 18, 1979, and Seeno became the owner thereof; and WHEREAS, Seeno has now installed and/or branded a permanent drainage facility servicing the entire Subdivision 5011, and as a result thereof, the aforesaid temporary storm drainage easement is no longer needed. On the recommendation of the Public Works Director, the Board of Supervisors hereby declares that .the aforementioned temporary storm drain easement is no longer needed or required by the County of Contra Costa, that said storm drainage easement is hereby terminated, and do hereby reconvey to Seeno the real property described in Exhibit A. NOW THEREFORE BE IT RESOLVED that the Public Works Director is authorized to refund to Seeno Construction the Certificate of Deposit dated Sept. 25, 1979 issued by Crocker National Bank, No. 339846 in the amount of $12,731 (Auditors Deposit Permit No. 23596, dated Sept. 27, 1}79) to guarantee payment for maintenance of the infiltration basin created by the temporary storm drain easement.
