HomeMy WebLinkAboutRESOLUTIONS - 01011981 - 1981-1020 t� IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the matter of Vacation of } RESOLUTION NO. 81/ 1020 Rights of Way for Three Bus } Gate: September 1 , 1981 Stops on Crow Canyon Road } Resolution of Summary Vacation San Ramon Area } Highway Vacation 1879 } (S&HC Sec. 8385) The Board of Supervisors of Contra Costa County RESOLVES THAT: This vacation is made pursuant to Streets and Highways Code Section 8330. Crow Canyon Road widening and improvement plans included the development of the subject bus stops. Later, under Assessment District 1979-4, the plans were revised to exclude the construction of these bus stops in view of the availability of the widened roadway to satisfy the possible future need for these bus stops. Now the rights of way for the subject bus stops are no longer required for a public purpose. For a description of the portion to be vacated, see Exhibit "A" Wached hereto and incorporated herein by this reference. (3 parts This board hereby FINDS that the proposed vacation will not have a significant effect on the environment, and that it has been determined to be categorically exempt under State quidelines Section 15112 in compliance with the California Environmental Quality Act. This vacation is not located in an area of statewide interest or in- any potential area of critical concern. The Planning Department having made its general plan report concerning this proposed vacation and this Board Navin considered the general plan, it finds pursuant to Government Code S 65402(a that in accordance with its Resolution No. 81/522 this vacation is of a minor nature. This Board declares that the hereinabove described proposed vacation area is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibit "A." From and after the date this Resolution is recorded, the portion vacated no longer constitutes a highway. This vacation is rade under the Streets and Highways Code, Chapter 4, Sections 8330 et seq. The subject rights of way have never been used as bus stops in the past. There is no present or anticiapted future use of these rights of way. The Public Works Director shall file with the County Clerk a Notice of Exemption. A certified copy of this Resolution, attested by the Clerk under seal , shall be recorded in the Office of the County Recorder. RESOLUTION NO. 81/1.020 r 7"S k EXHIBIT "A" (Part I) VACATION NO. 1879 Portion of lot "B", as designated on the map entitled "Map of the Albertsen Tract, San Ramon, Contra Costa County, California," which Map was filed in the Office of the Recorder of the County of Contra Costa, State of California, on June 15, 1896 in Volume 8 of Maps at page 31 , described as follows. Commencing at the intersection of the westerly line of said Lot "B" and the northerly line of Crow Canyon Road as said northerly line is described in the Offer of Dedication from Albert Marcotte, et al . to Contra Costa County recorded April 3, 1981 in Book 9800 of Official Record, at page 888, records of said County; thence from said point of commencement, north 790 40' 50" east, 208.95 feet; thence, north 760 21 ' 43" east, 160.97 feet to the true point of beginning; thence from said point of beginning northeasterly along a tangent curve concave to the northwest having a radius of 17.00 feet, through a central angle of 320 51 ' 35", an arc distance of 9.75 feet to a point of reverse curvature; thence along a curve concave to the southeast having a radius of 33.00 feet, through a central angle of 320 51 ' 35" , an arc distance of 18.93 feet to a point on a line parallel with and 61 .00 feet northerly, measured at right angles from the centerline of Crow Canyon Road, as said centerline is shown on the map entitled "A Precise Section of the Streets and Highway Plan, Contra Costa County, Crow Canyon Road" recorded October 22, 1962 in Book 4284 of Official Records, at page 614, records of said County; thence along said parallel line, north 760 21 ' 43" east, 100.00 feet; thence easterly along a tangent curve concave to the south having a radius of 33.00 feet, through a central angle of 320 51 ' 35" , an arc distance of 18.93 feet to a point of reverse curvature; thence easterly along a curve concave to the north having a radius of 17.00 feet, through a central angle of 320 51 ' 35" , an arc distance of 9.75 feet to a point on a line parallel with and 53 feet northerly of said centerline of Crow Canyon Road (4284 OR 614) ; thence along said parallel line, south 760 21 ' 43" west, 154.26 feet to the true point of beginning. Beginning at.a point on the "proposed R/W"=line as said line is shown on said parcel map (14 PM 34), said point distant, north 790 40' 50" east, 140.66 feet from the southerly boundary line of said Parcel "B", thence from said point of beginning, north 790 40' 501' east, 154.26 feet to a point of cusp with a tangent curve concave to the north having a radius of 17.00 feet, thence westerly along said curve, through a central angle of 320 51 ' 35" for an arc length of 9.75 feet to a point of reverse curvature; thence along a curve concave to the south with a radius of 33.00 feet through a central angle of 320 51 ' 35" for an arc length of 18.93 feet to a point on a line parallel with and distant 61 .00 feet northerly, measured at right angles, from the centerline of Crow Canyon Road, thence along said parallel line south 790 401 50" west, 100.00 feet, thence leaving last said parallel line along a tangent curve concave to the south with a radius of 33.00 feet through a central angle of 320 51 ' 35" for an arc length of 18.93 feet to a point of reverse curvature; thence along a curve concave to the north with a radius of 17.00 feet through a central angle of 320 51 ' 35" for an arc length of 9.75 feet to the point of beginning. EXHIBIT "A" (Part III) VACATION NO. 1879 Being a portion of Crow Canyon Road as said road is shown on the map of "Subdivision MS 75-78" filed December 14, 1978 in Book 72 of Parcel Maps, at page 44, Records of Contra Costa County, California, described as follows: Beginning at a point on the southerly right of way line of Crow Canyon Road, as said right of way is described in the Board of Supervisors Resolution number 81/332 recorded April 7, 1981 in Book 10271 of Official Records, at page 803, records of said county, said point of beginning being distant, south 790 40' 50" west, 78.56 feet from the most northerly corner of the parcel of land described in said Board of Supervisors Resolution (10271 OR 803); thence, from said point of beginning along said right of way (10271 OR 803), south 100 19' 10" east 18.00 feet; thence, south 790 40' 50" west, 20.00 feet; thence, north 10.00 feet; thence, south 790 40' 50" west, 119.58 feet to a point on the northerly line of Parcel "A" as said parcel is shown on said parcel map (72 PM 44); thence, along said northerly line north 810 30' 34" west to a point on a line parallel and 53.00 feet southerly, measured at right angles from the centerline of Crow Canyon Road, as said centerline is shown on said parcel map (72 PM 44); thence along said parallel line, north 790 40' 50" east, to the point of beginning. Bearings used in the above description are based on the California Coordinate System, Zone III .
