HomeMy WebLinkAboutRESOLUTIONS - 01011981 - 1981-1007 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of RESOLUTION NO. 81/1007 FY 1981-82 and FY 1982-83 Compensation for County Officers and Management and Unrepresented Employees WHEREAS the 1981-1983 compensation review for officers and certain employees of Contra Costa County has been accomplished in accordance with established procedure and the County Administrator has submitted a report proposing salary and benefit adjustments for elective and appointive officers and management employees not included in representation units and other employees not included in representation units; and WHEREAS the Board having thoroughly considered this report approves it; and WHEREAS it being necessary to adopt by Resolution certain provisions of this report; THE CONTRA COSTA BOARD OF SUPERVISORS RESOLVES: A. SALARIES AND INCENTIVES 1. General Adjustment: Effective July 1, 1981 , the salaries of the officers and employees whose classifications are set forth in the document entitled "Management and Unrepresented Salary Ranges" marked "Exhibit A" attached hereto and incorporated herein, are as specified therein. Effective July 1, 1982, the salary for those employees whose classifications are set forth in the document entitled "Management and Unrepresented Salary Ranges", marked "Exhibit A" attached hereto and incorporated herein and including any manage- ment or unrepresented classes which may be added hereto shall be increased by an amount not less than eight percent (8%) . However, if an increase in the Consumer Price Index for Urban Wage Earners and u'lerical Employees--San Francisco-Oakland, California-- All Items (196 7100) , here- inafter referred to as the "Index" should exceed twelve percent (12%) for the period April 1981 to April 1982, the salary range for those employees whose classifications are set forth in the document entitled "Management and Unrepresented Salary Ranges" marked "Exhibit A" attached hereto and incorporated herein, and including any manage- ment and unrepresented classes which may be added hereto, shall be increased an additional amount to be determined by subtracting twelve percent (12%) from the amount of increase in the index and dividing by two (2) ; said amount to be rounded to the nearest higher level on the appropriate salary schedule. No adjustments, retroactive or otherwise, shall be made in the amount of the salary increase due to any revision which later may be made in the published figures for the index for any month on the basis of which the increase has been determined. A decline in the Index shall not result in a reduction of classification salary rates. The salary increases based on the Index shall be contingent upon the continued availability of official monthly Bureau of Labor Statistics Price Index in its present form and calculated on the same basis as the foregoing Index (1967=100). Excepted from the aformentioned increase on July 1, 1982 are those management employees in departments where salaries of subordinate represented employees are governed by agree- ments with the County established for periods not coincident with the July 1 - June 30 fiscal year. Salaries for management employees so affected whose classifications are set forth in Exhibit C attached hereto and incorporated herein, including any management classes which may be added hereto, shall be considered for adjustment to maintain appro- priate differentials with subordinate represented classifications on the date specified in Exhibit C. Any such salary adjustment to classes in Exhibit C subsequent to the date(s) specified will be retroactive to that date. (1) RESOLUTION NO. 81/1007 x 2. Inequity Adjustment: Effective on the dates specified therein, the salary for those emp oyees whose classifications are set forth in the document entitled "Management and unrepresented Salary Inequity Adjustments", marked "Exhibit B" , attached hereto and incorporated herein shall be increased by the percentage amount specified. These increases are in addition to those noted above in paragraph Al (General Adjustment) . As may be recommended by the County Administrator, the Board shall consider for fiscal year 1982-1983 additional inequity adjustments, as yet unspecified for employees whose classifications are set forth in Exhibit A including any manage- ment or unrepresented classes which may be added thereto. 3. Department Head Adjustment: Effective July 1, 1981, all performance increments in effect for Department Heads are terminated. New performance increments to $200 monthly may be recommended by the County Administrator subject to approval by the Board. Effective July 1, 1982, all performance increments then in effect for Department Heads will be reviewed by the County Administrator for continuation or adjustment subject to approval by the Board. Base salary amounts for these classifications will be increased by a formula as noted above in paragraph 1 (General Adjustment) for fiscal year 1982-1983. Holidays: The County wi ► i observe the following holidays during the term covered by this Resolution: Labor Day New Year's Day * Admission Day * Lincoln's Day * Columbus Day Washington's Day Veteran's Day Memorial Day Thanksgiving Day Independence Day Day After Thanksgiving Christmas * Deleted as Holidays effective May 1, 1982 (2) RESOLUTION NO. 81/1007 Such other days as the Board of Supervisors may by Resolution designate as holidays. Effective May 1, 1982, Lincoln's Day, Admission Day and Columbus Day shall be deleted as holidays and all employees whose classifications are set forth in Exhibit A shall accrue two (2) hours of personal holiday credit per month. Such personal holiday time may be taken in increments of one (1) hour. No employee may accrue more than thirty-two (32) hours of personal holiday credit. On separation from County service the employee shall be paid for any unused personal holiday credits at the employee's then current pay rate. The days after Thanksgiving, November 27, 1981 and November 26, 1982 are deleted as holidays for all Management and Unrepresented employees in the County Library Depart- ment and the days before Christmas, December 24, 1981 and December 24, 1982, are added as holidays for these employees. Effective duly 1, 1981, for employees whose classifications are set forth in Exhibit A, any holiday listed above which falls on a Saturday shall be celebrated on the preceding Friday and any holiday listed above which falls on a Sunday shall be celebrated on the following Monday. If amendments to Government Code Section 6700 and/or 6701 become effective to delete any of the above as holidays or to add new holidays, such amendments shall be effective for employees whose classifications are listed on the document entitled "Management and Unrepresented Salary Ranges" attached hereto marked "Exhibit A" and incorporated herein. Permanent part-time management and unrepresented employees shall receive holiday credit in the same ratio to the holiday credit given full-time management and unrepresented employees as the number of hours per week in the part-time employee's schedule bears to the number of hours in the regular full-time schedule, regardless of whether the holiday falls on the part-time employee's regular work day. 2. Vacation Leave: (a) For employees hired prior to October 1, 1979 the rates at which vacation credits accrue, and the maximum accumulation thereof, are as follows. Administrative Leave: All provisions of the paid personal leave plan for management employees as set forth in section 3h of Resolution 79/781 are continued ~ for the term of this Resolution. 4. Sick Leave: Employees whose classifications are listed on Exhibit A shall receive the following benefits under procedures established by the County Administrator: 1) Effective September 1, 1981, the County Administrative Bulletin 311.2 on Sick Leave shall be amended to (a) allow usage and accrual of sick leave credits in one- half (;�) hour increments, (b) the use of paid sick leave credits in the amount of thirty-two (32) hours per fiscal year for pre-scheduled medical and dental appoint- ments for an immediate family member living in the employees home and (c) the use of paid sick leave credits up to three days (unless more is approved by the Department Head) in cases of illness or injury to an immediate family member living in the employee's home if there is a real need for someone. to render care. 2) Sick leave utilization for pregnancy disability: Employees whose disability is caused or contributed to by pregnancy, miscarriage, abortion, childbirth, or recovery therefrom, shall be allowed to utilize sick leave credit to the maximum accrued by such employee during the period of such disability under the conditions set forth below: (a) Application for such leave must be made by the employee to the appointing authority accompanied by a written statement of disability from the employee's attending physician. The statement must address itself to the employee's general physical condition having considered the nature of the work performed by the employee, and it must indicate the date of the commencement of the disability as well as the date the physician anticipates the disability to terminate. The County retains the right to medical review of all requests for such leave. (b) If an employee does not apply for leave and the appointing authority believes that the employee is not able to properly perform her work or that her general health is impaired due to disability caused or contributed to by pregnancy, miscarriage, abortion, childbirth or recovery therefrom, the employee shall be required to undergo a physical examination by a physician selected by the County, the cost of such examination to be borne by the County. Should the medical report so recommend, a mandatory leave shall be imposed upon the employee for the duration of the disability. (c) If all accrued leave has been utilized by the employee, the employee shall be considered on an approved leave without pay. Sick leave may not be utilized after the employee has been released from the hospital unless the employee has provided the County with a written statement from her attending physician stating that her disability continues and the projected date of the employee's recovery from such disability. 3) Permanent disability sick leave: Permanent disability means the employee suffers from a disabling physical injury or illness and is thereby prevented from engaging in any County occupation for which he is qualified by reason of education, training or experience. Sick leave may be used by permanently disabled employees until all accruals of the employee have been exhausted or until the employee is retired by the Retirement Board, subject to the following conditions: (a) An application for retirement due to disability has been filed with the Retirement Board. (b) Satisfactory medical evidence of such disability is received by the appoint- ing authority within 30 days of the start of use of sick leave for permanent disability. (c) The appointing authority may review medical evidence and order further examination as he deems necessary, and may terminate use of sick leave when such further examination demonstrates that the employee is not disabled, or when the appointing authority determines that the medical evidence submitted by the employee is insufficient, or where the above conditions have not been met. (4) RESOLUTION NO. 81/1.007 C. BENEFITS AND ALLOWANCES 1. Group Health Insurance: The County will continue the existing County Health Plan program of combined medical , dental and life insurance coverage through California Dental Service, Occidental Life Insurance and the medical insurance options of Kaiser-Permanente Foundation and Blue Cross of Northern California and will add the medical insurance option offered by the Contra Costa Health Plan (CCHP) and Herrick-Alta Bates Health Service (HEALS). Effective on the dates indicated, for classified, exempt and project management employees unrepresented employees in comparable classes as designated by the Employee Relations Officer and elected officials whose classifications are listed in Exhibit A, the County will contribute up to the following monthly amounts toward the existing County Group Health Plan program of combined medical , dental and life insurance coverage, provided however that the minimum employee health plan contribution shall be $1.00 per month. These figures apply to both active and retired employees. Family Blue Status Kaiser Cross CCHP HEALS 8/1/81 8/1/82 8/1/81 8/1/82 8/1/81 8/1/82 8/1/81 8/1/82 Single $ 47.97 $ 55.97 $ 72.769 $ 80.76 $ 49.07 $ 57.07 $ 60.00 $ 68.00 Family 110.73 122.73 126.41 138.41 . 115.30 127.30 115.00 127.00 Corresponding Medicare rates for employees covered in this Resolution shall be as follows: For Employee Only on Medicare by taking the Employee Only rate for the option selected and subtracting the monthly Part B Medicare premium withheld from Social Security payments for one enrollee; for Employee and Dependent(s) with one member on Medicare by taking the Employee and Dependent(s) rate for the option selected and subtracting the monthly Part B Medicare premium withheld from Social Security payments for one enrollee; for Employee and Dependent(s) with two members on Medicare by taking the Employee and Dependent(s) rate for the option selected and subtracting the monthly Part B Medicare premium withheld from Social Security pay- ments for two enrollees; provided however that the minimum employee health plan contribution will be $1.00 per month. 2. Medical Treatment for Job Injuries: Whenever an employee who has been injured on the job and has returned to work is required by his/her attending physician to leave work for treatment during working hours he/she shall be allowed time off up to three (3) hours for such treatment without loss of pay or benefits. This provision applies only to injuries that have been accepted by the County as a job-connected injury. 3. Permanent-Intermittent Health Plan Participation: Effective October 1, 1981 a Permanent-Intermittent employee whose classification is set forth in Exhibit A may participate in the County group Health Plan of combined medical , dental and life insurance coverage wholly at the employee's expense. The County will not contribute to the employee's monthly premium and the employee will be responsible for paying the monthly premium appropriately and punctually. Failure to meet the monthly premium deadline will mean automatic and immediate withdrawal from the County Group Health Plan and reinstatement may only be effectuated during the annual open enrollment period. 4. Provisional Employee Health Plan Participation: Effective October 1, 1981, para- graph ZbEligibiliIX of section 36-8. 1202 County Ordinance Code (as operative under Resolution 81/581) is extended to employees provisionally appointed to permanent positions in classifications set forth in Exhibit A for the purpose of allowing participation in the County group Health Plan of combined medical , dental and life insurance coverage wholly at the employee's expense. Other conditions of premium payment as noted above in paragraph C4 (Permanent-Intermittent Health Plan Participation) shall apply to these provisional employees. 5. Safety Shoes and Prescription Safes Eyeglasses: The County shall reimburse employee for safety shoes and prescription safety eyeglasses in those classifications set forth in Exhibit A which the County has determined eligible for such reimbursement. The County will reimburse eligible employees for safety shoes in an amount not to exceed twenty dollars (20.00) per pair to a maximum of two (2) pair in any year. The County will reimburse eligible employees for prescription safety eyeglasses which are approved by the County and are obtained from such establishment as required by the County. (5) RESOLUTION NO. 81/1007 6. Mileage Reimbursement: Effective August 1, 1979, for management and unrepresented employees whose classifications are listed on Exhibit A, excluding Department Heads, mileage allowance for the use of personal vehicles on County business shall be paid according to the following per month formula: 1 - 400 miles ---------------------$ .22 per mile 401 - plus miles -------------------$ .16 per mile The above rates shall be adjusted to reflect an increase or decrease in the cost of gasoline which shall be determined as provided below on the basis of the average price of "gasoline, all types" per gallon as listed in Table 5, "Gasoline Average Prices Per Gallon, U.S. city average and selected areas" for the San Francisco-Oakland, California area published by the Bureau of Labor Statistics, U.S. Department of Labor, hereinafter referred to as the "Energy Report". The above mileage rates shall be increased or decreased by one cent (1¢) for each fifteen cents (15fl increase or decrease in the base price for gasoline which shall be defined as the average price of gasoline per gallon for July, 1979 as published in the Energy Report. Any such rate increase or decrease shall be effective the first of the month following publication of the Index. The above formula rates include price increases reported since July 1979. The mileage rate increase or decrease based on the Energy Report shall be contingent upon the continued availability of the official monthly Energy Report in its present form and calculated on the same basis. Mileage allowance for the use of personal vehicles on County business by employees in the class of Supervising Appraiser shall continue to be paid according to the following per month formula and are subject to adjustment as above: 1 - 600 miles ------------------------$ .22 per mile 601 - plus miles -----------------------$ .16 per mile 7. Automobile and Mileage Allowance for Department Heads: All provisions of the executive automobile allowance program as set forth in section 3i of Resolution 79/781 shall remain in effect for the term of this Resolution except that the per mile allowance is increased from 17¢ to 19t. 8. Retirement Contribution: Pursuant to government Code Section 31581.1, the County will continue to pay 50% of the retirement contributions normally required of management and unrepresented employees whose classifications are listed in Exhibit A. Such payments shall continue for the duration of this Resolution, and shall terminate thereafter. Employees shall be responsible for payment of the employee's contribution for the retirement cost of living program as determined by the Board of Retirement of the Contra Costa County Employees' Retirement Association without the County paying any part of the employee's share. The County will pay the remaining one-half (1�) of the retirement cost of living program contribution. 9. Life Insurance: Classified, project and exempt management employees, excluding department heads, whose classifications are identified in Exhibit A shall continue to be provided with a $30,000 term life insurance policy. . Elected officials and all department heads, elected and appointed, shall be provided with $50,000 term life insurance policies. Premiums for this insurance shall be paid by the County with conditions of eligibility to be reviewed annually. For the purpose of this section, department heads eligible are those listed in section A3, including Fire Chief, Fire Chief-Riverview Fire Protection District and Fire Chief-Group II . 10. Professional Development Reimbursement: Classified, project and exempt management employees excluding department heads and their chief assistants whose classifications are identified in Exhibit A shall be eligible for reimbursement up to $150 per fiscal year for memberships in professional organizations, subscriptions to professional publications and attendance fees at job-related professional development activities. Department heads and their chief 9ssistant(s) shall be eligible for similar reimburse- ment in the amount of $300 per fiscal year. Authorization for individual professional development reimbursement requests shall be made by the department head. The Office of the County Administrator shall establish guidelines defining job-related professional development activities. 11. Lon -Term Disabilit Insurance: The present long-term disability insurance program LTD or c assified, project and exempt management employees and elected officials whose classifications are listed in Exhibit A shall be amended to (1) reduce the present 120 day waiting period to 60 days, (2) eliminate the requirement that all (6) RESOLUTION NO. 81/1.007 n vacation and sick leave accruals be exhausted prior to use, and (3) eliminate the requirement for deduction of other group insurance coverages from benefits. The premium for this long-term disability insurance program shall be fully paid by the County. 12. Vacation Payoff: Classified, exempt and project management employees, excluding elected officials, whose classifications are listed in Exhibit A shall continue to be eligible for pay for one-third of their annual accumulated vacation at such time as they elect such payment. Vacation balances will be reduced by the number of hours paid for. This option may be utilized by each eligible employee only once each calendar year. 13. Training and Book Allowances: Reimbursement for career development training shall continue to be limited to 200 per semester or $150 per quarter, not to exceed $500 per year. All employees in the classifications of Assistant District Attorney, Senior Deputy District Attorney-Exempt, Deputy District Attorney, Deputy District Attorney III , Deputy District Attorney IV, Chief Deputy County Counsel , Assistant County Counsel , Chief Deputy Public Defender, Chief Trial Deputy Public Defender and Assistant Public Defender, shall be eligible for a maximum reimbursement of $175 per fiscal year for the purchase or replacement of law books and/or for the reimbursement of training expenses incurred in the pursuit of educational courses, the subject(s) of which are directly related to the job duties of a Criminal or Civil Attorney employed by a public jurisdiction. The reimbursement of training expenses shall be consistent with the Administrative Bulletins on Travel and Training. Incumbents in the classification of Deputy County Counsel I, I1, III and IV shall be eligible for a maximum reimbursement of $175 per fiscal year for the purchase or replacement of law books and/or for the reimbursement of training expenses incurred in the pursuit of educational courses, the subject(s) of which are directly related to the job duties of a Deputy County Counsel . The reimburse- ment of training expenses shall be consistent with the Administrative Bulletins on Travel and Training. 14. Uniform Allowance: The uniform allowance for positions in the management class of Animal Control Supervisor shall continue to be $27.50 per month . The monthly uniform allowance for management employees of the five County Fire Protection Districts including: Consolidated, Riverview, West, Moraga and Orinda in the classifications of Fire Chief, Fire Chief-Riverview Fire Protection District, Fire Chief Croup II, Assistant Fire Chief group I, Assistant Fire Chief-Riverview Fire Protection District, Assistant Fire Chief Croup II , Battalion Chief, Battalion Chief-Riverview Fire Protection District, Fire Marshal Croup II, Fire Officer-Exempt, Fire District Communications Supervisor, Fire Training Supervisor and Supervising. Fire Inspector shall continue to be $25.00. The monthly uniform allowance for management employees in the Sheriff-Coroner Department in the classifications of Chief Executive Assistant Sheriff, Assistant Sheriff, Captain, Lieutenant, Deputy Sheriff-Chief Criminalist Laboratory, Supervising Criminalist, Supervising Communications Technician, Administrative Services Assistant II and III and Administrative Services Officer shall continue to be $27.50 per month until October 1, 1981, at which time it shall be increased to thirty ($30.00) dollars per month. 15. Bilingual Pay: A salary differential of $50 per month shall be paid management and unrepresented employees whose classifications are listed in Exhibit A and who are incumbents of positions allocated to classifications requiring bilingual proficiency as designated by the County. Said differential shall be pro-rated for employees working less than full-time and/or on an unpaid leave of absence during any given month. Designation of positions for which bilingual proficiency is required is the sole perogative of the County, and positions which may now or in the future require special language skills may have such requirements amended or deleted. lb. Fire Service Emergency Recall and Standby Differential : Effective September 1, 1981 and terminating June 30, 1982, a salary differential in the amount of five percent (51) of the monthly base salary shall be in effect for management personnel in the Consolidated, Orinda, Moraga and River Fire Protection Districts subject to assigned standby and emergency recall a minimum of 2 (two) weeks each month. Such personnel assigned to standby and emergency recall for one (1) week in each 4 (four) (7) RESOLUTION NO. 81/1007 consecutive creeks shall receive a differential in the amount of two and one half percent (2.5%) of the monthly base salary. Fire Chiefs of the Consolidated, Orinda, Moraga and River Fire Protection Districts are not subject to the standby and emergency recall differentials stated herein. D. TERMS AND CONDITIONS OF EMPLOYMENT 1. Part-Time Employees: Part-time classified, exempt and project management employees whose classifications are listed in Exhibit A, who work at least 50% of full-time on a continuing basis shall be provided the management benefits listed in this Resolution on a full or pro-rata basis. 2. Permanent-Intermittent Employees: Permanent-Intermittent employees whose classifi- cations are set forth in Exhibit A are eligible for vacation and sick leave benefits as defined in this Resolution on a pro-rata basis. 3. Length of Service Credits: For all employees whose classifications are listed in Exhibit A, the length of service credits of each permanent employee shall date from the beginning of the last period of continuous County employment including temporary, provisional and permanent status and absences on approved leave of absence except that when an employee separates from a permanent position in good standing and is subsequently re-employed in a permanent County position, prior to the completion of two years from date of separation, the period of separation will be bridged. Under these circumstances the service credits shall include all credits accumulated at time of separation but shall not include the period of separation. The service credits of an employee shall be determined from employee status records of the Personnel Department. 4. Mirror Classifications: Employees in unrepresented job classifications shall continue to receive the salary and fringe benefits that are received by employees in comparable classifications as determined by the Employee Relations Officer. 5. Deep Classes: No provisions of this Resolution regarding terms and conditions of employment for classified management employees is intended to supersede any specific provision in effect within any separate "deep class" Resolution for management classifications. 6. Administrative Provision: The County Administrator shall establish guidelines, bulletins or directives as necessary to further define or implement provisions contained in this Resolution. All provisions of Divisions 36 (Terms of Employment and Compen- sation) of the County Ordinance Code (operative under Resolution 81/581) shall continue to apply to management and unrepresented employees covered by the terms of this Resolution.
