IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Fatter of Acquisition and Exchange ) of County Property with Property Owner ) RESOLUTION NO. 69/8 .1 (Goetz) for El Portal Drive - County ) Road No. 0871, San Pablo area - ) (S . &H. Cade Work Order #4145 } Section 960.4) The Board of Supervisors of Contra Costa County RESOLVES THAT: Portions of County property described in the deed from Frank Fuerst , et al. , recorded October 24, 1969, in Volume 5990, Official Records , at page 2010 , are no longer required for County highway purposes ; and A portion of real property owned by P. R. Goetz, et ux, adjacent to said County-owned real property, is required for the widening and improvement of El Portal Drive in San Pablo. The County Right of Way Agent report's that said excess portion of County property and payment of $12 ,950.00 is fair market value for said portion of adjacent property,, and so this Board so finds and hereby approves this exchange of real' property and payment of TWELVE THOUSAND NINE HUNDRED FIFTY and no/100 DOLLARS ($12,950. 00) as part of that certain Right of qday Contract with: P. R. Goetz and Jeanne L. Goetz , his wife, dated December 2, 1969 and approved concurrently by this Board pursuant to Streets and Highways Code 960. 4 . This Board authorizes and directs its Chairman to execute on behalf of the County, a grant deed conveying to P. R. Goetz and Jeanne L. Goetz, his wife,, the real property described in Exhibit "A" attached hereto and made a part hereof, and directs the Clerk of the Board to deliver said deed upon compliance and performance by the grantees of all the terms or conditions of their contract to be performed concurrently therewith. The Auditor-Controller is directed to draw a warrant in favor of Title Insurance and Trust Company, Escrow No. MZ-146523 in the sum of $12,950. 00 for payment to P. R. Goetz and Jeanne L. Goetz, his wife, for a good and sufficient deed to Contra Costa County for the real property described in said Right of Way Contract . The deed from P. R. Goetz , et ux, dated December 2, 1969, is hereby accepted; and the Clerk of this Board is directed to have said document recorded in the office of the Recorder of this County a certified copy of this resolution. -1- RESOLUTION NO. 69/841 ............................................................ El Portal Drive 0871-4145-65 Parcel 22 - Excess EXHIBIT "A" A portion of Lot 135 as shown on the map entitled "Map of San Pablo Rancho, accompanying and forming a part of the Final Report of the Referees in Partition" , which map was filed in the office of the Recorder of the County of Contra Costa, State of California, on March 1 , 1894 , described as follows : Commencing on the southern line of Road No. 20 as shown on the map hereinbefore referred to at the northeast corner of the parcel of land described in the deed from Zane D. Taylor, et ux, to Oran W. Davis, et al, recorded February 15, 1960 in Book 3556 of Official Records at page 454; thence from said point of commencement South 01 45' 58" West , along the east line of said Davis parcel ( 3556 OR 454), 41. 02 feet to a point on a line which runs parallel to and 61 feet, measured at right angles South of the centerline of said Road No. 20 , said point being the true point of beginning. Thence along said parallel line South 870 16 , 07" East, 60 feet , thence leaving said parallel line, South 01 45' 58" West to the centerline of San Pablo Creek; thence southwesterly along the centerline of said Creek to a point which bears South 00 45' 5811 West of the true point of beginning, being also the southeast corner of said Davis parcel ( 3556 OR 454 ) ; thence along the east line of said Davis parcel, North oo 45' 5811 East to the true point of beginning. The Grantee , their heirs , successors or assigns , by the acceptance of this deed hereby agree to convey and dedicate a drainage easement to any public body at such time when San Pablo Creek is improved by that public body. Said improvements to be constructed at no expense to Grantee or their heirs, successors or assigns . The boundaries of said dedication will not exceed the top bank of San Pablo Creek as it will exist at that time . 6q .............................................. ............
