RESOLUTION ORDERING THE ANNEXATION OF THE
TERRITORY. OF THE MORAGA FIRE PROTECTION
DISTRICT TO THE CONTRA. <COSTA COUNTY FIRE
PROTECTION DISTRICTSUBJECT TO THE
CONFIRMATION OF THE VOTER
The Beard' of Supervisors of Centra. Costa County RESOLVES THAT:
On September 10, 1969, this Board adapters Resolution No,.69/586
initiating; proceedings for the annexation of the territory of the
Moraga Fire Protection District to the Contra Creta County Five
Protection District. This annexation had been proposed by the
Board of Supervisors.,
Resolution of; application for the proposed change of
organization was filed by they Board of Supervisors viith the
Executive Officer of the Local agency Formation Commission on
July 8, 1969. The reason for the proposed annexation is that;
said annexation will. provide the inhabitants of the territory; of
the Moraga;' Fire Protection District >'with Fetter fire Protection
services at a 'lower tax rate.
On September 3, 1969, the Local. Agency Formation Commission
approved the resolution subject' to the following conditions -
(a)
onditions ;(a) Upon completion of the annexation, all paid full'l time
personnel of the Moraga Fire Protection District -shall be
transferred to reasonably similar positions in the Contra Costa
County Fire Protection ''District. Such transfers' shad be effected
in accordance with the ;previsions of the County Ordinance Code and
Civil 'Service 'Rules and Regulations.
(b) Upon completion of the annexation, the Centra Costa
County Firs' Protection ''District shall succeed to all of the asset`
and liabilities of the Moraga Fire Protection District.
(c) Upon completion of the annexation, any; monies due to, but
not yet received by 'the Moraga Fire protection District, shall be;
collected by and credited is the Contra <Costa County Fire Protection
District ,

(d) Upon completion of the annexation, the Moraga Fire
Protection District shall not impose any further taxes upon the
area of that district .
(e) If an election is called upon the question of confirming
an order for this proposed annexation, the election shall be
called, held and conducted upon such question only -within the
territory ordered to be annexed. With such an election, the
effective ve annexation date may be changed.
The Local Agency Formation Commission also declarer? the
territory proposed to be annexed as inhabited , and assigned the
proposal designation as "Moraga Fire Protection District Territory
Annexation to the Contra Costa County Fire Protection District" .
The exterior boundaries of the territory proposed: tobeannexed
are as described in Exhibit "A" attached hereto and by reference
incorporated herein.
The Board's Resolution No 69/586 fixed 10 :01 a.m. on Tuesday,
October 28, 1969, as the time for a public hearing on the annexa-
tion of the above said territory. Notice of said hearing, was duly
given by (1.) publication in the "Centra. Costa Times" , (2) posting
on this Board's bulletin board, and (3) railing notice to, all
persons and counties, cities or districts , which had filed a
written request for special notice with the Clerk of this Board.
This Board, at the time and place set for said hearing, heard the
determination of the Local Agency Formation Commission read aloud,
and then called for evidence or protests as provided for by
Government Code Section 56314. The Board then and there heard and
duly considered evidence and protests offered concerning the
annexation. A' petition was presented to the Board protesting the
annexation of the territory to the Contra Costa County Fire
Protection District and requesting that, an election be called on
the issue. The Beard then continued the hearing to 0: 30 a.m. on
November 25, 1969, at which time the Board heard»- and 'duly considered
further evidence and protests offered concerning the annexation.
This Board hereby finds that the proposed annexation of the
territory of Moraga. Fire Protection District to the Contra Costa
County Fire Protection District is in the best interest of the
peopleof the above said territory and Contra Costa County Fire
Protection District. This Board also finds that the above said
territory is inhabited. This Board hereby orders the territory
of the Moraga Fire Protection District , as described in attached '
Exhibit "A", annexed to the Contra Costa: County Fire' Protection
District ,, subject to the confirmation of the voters upon the
question of such annexation. This Beard fixes June 2, 1970, as
the date for the election to be held on such question and provides
that the election be held only within the territory ordered to be
annexed.
