HomeMy WebLinkAboutRESOLUTIONS - 01011969 - 69-768 BEFORE THE 'BOARD OF SUPK" TISORS OF COUNTY OF CONTRA COSTA, STATE OF CALI OR�'IA In the =!atter of the Proposed } Abatement of the .rroperty of RESOLUTION 69/768 Ida Robison } } WHEIR :AS it appears from the records of this Boardthat the Contra Costa County Building Inspector, acting in accordance with sections 342 and H-1001 and -1002 of -the Uniform Building Cade and sections 17014 at sed,. of Title UII of the California Administrative Code, having determined that the building* located rear the northwesterly and easterly property lines near Redwood Highway in the Canyon area and more narti.cularly described as set forth in "exhibit a", attached hereto, which is incorporated herein by reference, is a substandard building an d is therefore a public nuisance; and: said %ildi.ng Inspector having posted. said property with Not .ce of Substandard Buildin and having notified the owner of said property that it is a substandard building in the manner -srov1ded by law as appears more particularly from the declaration. of the Building Inspector on file herein; and :4HKAEAS the said building has not been repaired or removed as required by said :otica of Substandard Building; and IW AS said Building Inspector thereafter posted said property with Notice to Abate >hxi sance, i�kich notice specified the time and place of the hearing before this Board for the owners of said property to show cause why the bull, ng thereon should. not be condemned as a 'public nuisance, and the Building Inspector having notified the owners of said. property of said hearing in the manner ?provided by law, as appears more particularly from the declaration of the Building 'Inspector on file herein; and klK—CAS the matter having come on for hearing by this hoard on Tuesday, 4overnber 18, 1969, at 0:45 A. M. as provided in the notice hereinabove mentioned; and ;AHEREAS the Beard having considered the evidence presented by said Building Inspector and all other interested parties, the following appears and thiw Board now finds that said building is a substandard building as defamed in Sections H-1001 and. H-1002 of the Uniform Building Code by reason of the .following deficiencies which are hereby found to exists Sae " hdbit A" attached hereto which is incorporated herein by reference. .QE, IT 'I`H'&-,',WC W' OLVED that said building is substandard and is declared to be a public nuisance and the owners thereof are hereby ordered to abate said nuisance within 30 days after a copy of this resolution, together with notice thereof, has been posted to said property; F 3-D--194'7 69 /768 BE II FURTHMi RESOLVED that it is the conclusion of this Board that said building cannot be reconstructed or repaired in a manner so as to comply with the -oro inions of .Article .9, 'Chapter 9 of 'Title IIII of the California A,:c�hinistrative Code or the Unifom Building Code as incorporated in the Contra Costa County Ordinance Code and therefore said building .must be razed or removed. IT IS FURTHER OIRMSRED that if said nuisance is not abated within the time allowed, said nuisance will be abated by the Building Inspector of this county, and the eitpense thereof made a lien upon the lard upoq which said building is located. Vol. 111, Section ? --?001(o) in that the building or portions thereof are not properly designed to be used for living, sleeping, cook- ing or dining; purposes , for the follo�rin�; reasons a. The structure does not have minimum Living space for the occupants . b . The dwelling lacks plumbing fixtures . c . The dwelling lacks room separations . d. The structure does not have the minimum ceiling height for a dwelling . e . The dwelling is not connected to available electrical power.
