HomeMy WebLinkAboutRESOLUTIONS - 01011969 - 69-576 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of the ) RESOLUTION NO. 69/576 Formation of the Canyon ) Community Services District )\ (Gov.C. 61113, 61114) f RESOLUTION DISMISSING THE PETITION AND TERMINATING PROCEEDINGS FOR THE FORMATION OF THE CANYON COMMUNITY SERVICES DISTRICT The Board of Supervisors of Contra Costa County RESOLVE'S THAT; On July 3, 1969, there was filed with this Board a petition for the formation of a community services district in a portion of the unincorporated territory of the county (Canyon) . The petition was signed by at least ten percent of the registered voters within the proposed district . As stated in the petition, the purposes for which the community services district is to be formed are : "(a) To supply the inhabitants of the district with water for irrigation, sanitation and fire protection; (b) To collect, treat and dispose of sewage and waste water of the district and its inhabitants (c ) To collect , treat and dispose of garbage or refuse matter; (d) To protect against fire. " On February 7, 1969, prior to the circulation of said petition, the proponents of the formation of proposed Canyon Community Services District filed application with the Executive Officer of the Local Agency Formation Commission for approval for said formation. On June 1:1., 1969, the Local Agency Forma- tion Commission approved the proposed formation subject to the condition that : "The Board of Supervisors shall constitute the Board of Directors of the district. " On July 8, 1969, the Board ordered that the date for a public hearing on the petition for formation of the Canyon Com- munity Services District be fixed as August 5 , 1969, at 2 p.m. At this hearing this Board determined that the, petition was genuine and sufficient and complied with the law. By order of this Board on August 5, 1969, the hearing was continued to August 19, 1.969, and on that date the hearing was further con-- tinued. to September 2, 1969. At the hearing the petition was heard and these appearing in favor thereof and those making oral or written protests against the formation of the proposed district were also heard. -l- RESOLUTION NO. 69/576 This Board at the hearing also was presented with requests from owners of land within the proposed district for exclusion of this land from said district . On August 19, 1969 , pursuant to Government Cade Section 54799.1, this Board applied to the Local Agency Formation Commission, requesting that said Commis- sion consider exclusion from the proposed Canyon Community Services District of all of the propertiesfor which requests for 'exclusion had theretofore been filed; but on August 2'0, 1969, the Local Agency Formation Commission denied' this application in whole. This Board has duly .heard and considered the evidence of the proponents and the persons and agencies opposing formation of the district and requesting exclusion therefrom. This Board hereby determines and finds from evidence taken at the hearing that the proposed district, as its, boundaries are described in the petition, is not in the public interest and not economically feasible. Therefore this Board hereby dismisses the petition and terminates these proceedings for the formation of the proposed Canyon Community Services District`.
