In the Matter of Authorizing Partial
Release of a Portion of Real Property
Sold by County and Secured by Note RESOLUTION NO. 69/ 468
and Trust Deed (Former Southern Public
Utility District Land in Diablo Area. )
The Board of Supervisors of Contra Costa County RESOLVES THAT:
On August 23 , 1966 this Board, pursuant to Resolution #5445,
approved
pproved and accepted a promissory note and deed of trust dated
July 27 , 1966 in the amount of $60,000 for County property sold
to Eugene J. Lehner and Joseph P. Muzzy ;
On June 17, 1969 , this Board received a request by letter
from George B. Watts , Site Finders Realtors , 2090 Willow Pass Road ,
Concord, California,, for a partial release of a portion of said
property in order for the owners to effect an exchange for another
parcel of land which would give the remaining property better
accessibility to Caballo Ranchero Drive .
On recommendation of the County Right of Way Agent that the
release of said portion of property will not , In his opinion,
diminish the value of the remaining property , as secured in said
deed of trust, this Board finds that the release of said portion
is In the best mutual interest of the County and the TruAors under
said deed of trust for the development of the remaining
., prope ty.
This Board hereby approves the release of said Portionlof real
property described as Parcel A In Exhibit "A" attached I hereto and by
reference incorporated herein. The Trustee, Western Title Ouaranty
Company, is hereby authorized and requested to prepare and execute
a Partial Reconveyance of said deed of trust recorded September 12.1
1966, in Book 5201, at page 213, Official Records of Contra Costa
County, for the portion of property described herein as said
Parcel A in Exhibit "A" , and deliver and record said Partial. Recon
-
veyance to the Trustors therein, when title to the real property
described as Parcel B in Exhibit "B" attached hereto and by reference
incorporated herein, is vested in the. Trustors of said deed of trust
(5201 OR 213) . All reconveyance and recording fees and other costs
incurred in this partial release sball be >borne by said Trustors .
PASSED AND ADOPTED on July 15 , 1969 by this Board .

Beginning on the westerly terminus of. Caballo Ranchero Drive,
at the north line of Lot 12 . as designated on the map entitled,

County, California", which map was filed in the office of the Re-
corder of the County of Contra Costa, State of California, on

together with the necessary poles or conduits to carry said lines,
over, under and upon the entire parcel above described.
