IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COMiTY, STATE OF CALIFORNIA RESOLUTION NUMBER 69/308 In the Matter of Approving Recommendations of the Contra Costa County Land Conservation Committee with Respect to the County Land Conservation Program, I WHEREAS Mr, A. L. Seeley, Chairman of the Contra Costa County Land Conservation Committee, appeared before the Board and stated that in light of the first year of experience in receiving, reviewing and acting upon applications for the establishment of agricultural preserves and because the Committee is of the opinion that the procedure for establishing agricultural preserves should be integrated with and made a part of the regular county planning processes, and further that because the Land Conservation Act of 1965 is to be applied only to bona fide commercial agri- cultural lands, the Committee recommended that amendments be made to the county land conservation program as follows: 1. That Resolution Number 68/635 adopted September 17, 1968 (which promulgated rules and regulations for creation of agricultural pre- serves and negotiation of land conservation agreements and established an Agricultural Pre- serve Screening Committee) be amended so as to eliminate the Agricultural Preserve Screening Committee and to require that all applications for agricultural preserve zoning be processed through the Planning Department and the Planning Commission in the same manner as any rezoning application; and 2. That Ordinance Number 68-53 (section 8610-3) be amended to provide that agricultural preserves shall include only those lands whose primary use is commercial agricultural pro- duction; and WHEREAS Mr. Seeley further stated that it is the opinion of the Committee that Board approval of aforesaid recommendations will improve the administration of the county land conservation program; and WHEREAS Mr. Seeley requested on behalf of said Land Conservation Committee that immediate action be taken on said recommendations inasmuch as applications for establishment of agricultural preserves, effective March 1, 1970, have already been mailed; NOW, THEREFORE., BE IT BY THE BOARD RESOLVED that the recommendations of the Contra Costa County Land Conservation Committee are approved. RESOLUTION NUMBER 691308 BE IT BY THE BOARD FURTHER RESOLVED that Resolution Number 68/635 is amended so as to eliminate the Agricultural Preserve Screening Committee and to require that all applica- tions for agricultural preserve zoning (A-4) be processed through the County Planning Department and the County Planning Commission in the same manner as any rezoning application. BE IT BY THE BOARD FURTHER RESOLVED that the Acting District Attorney is directed to prepare an ordinance amending Ordinance Number 68--53 (Section 8610.3, Uniform Standards) to provide that agricultural preserves shall include only those lands whose primary use is commercial agricultural production said ordinance to be submitted to the Board for adoption at the earliest practicable date. PASSED AND ADOPTED this 6th day of May, 1969 by the following vote: AYES: Supervisors J. P. Kenny, A. M. Dias, T. J. Coll, E. A. Linscheid, J. E. Moriarty. NOES: None. ABSENT: None .
