HomeMy WebLinkAboutRESOLUTIONS - 01011969 - 69-190 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Summary Abandonment and quitclaim of Superseded Portion of Somers- RESOLUTION N0. 69/190 ville Road Slope and Drainage Easement, (County Road No. 5971) (S. & H. C . 960.1) The Board of Supervisors of Contra Costa County RESOLVES THAT: A certain slope and drainage easement previously acquired for the County road, known as Somersville Road (County Road No. 5971) , has been eliminated by merging a portion of said easement with the fee title widening of Somersville Road and the remainder in the development of the adjacent property. Said elimination will not cut off access to the property of any person, which prior to such relocation adjoined the highway. It appears proper that said remaining portion of eliminated slope and drainage easement no longer needed for County pur- poses be summarily abandoned as provided in Section 960.1 of the Streets and Highways Code. That all that portion of said County Highway, superseded by removal of the necessity for said easement, and more particularly described herein as follows, be and the same is hereby ABANDONED, and the Clerk of the Board of Supervisors is directed to cause a certified copy of this resolution to be recorded in the office of the County Recorder of the County of Contra Costa: All that portion of the parcel of land for use as a slope and drainage easement, described as Parcel Nineteen in the deed to Contra Costa County, re- corded August 13, 1957, in Book 3028, Official Records, at page 44, which portion lies adjacent to and northwesterly of the northwest line of the parcel of land described as Parcel II in the deed from United States Steel Corporation to Contra Costa County, recorded September 12, 1968 in Volume 5707 of Official Records at page 235. The Chairman of this Board is authorized and directed to execute a quitclaim deed on behalf of the County of Contra Costa to the present owners of servient tenement, namely, United States Steel Corporation, for said abandoned portion of super- seded road easement. PASSED AND ADOPTED on Mar. 18, 1969 by the following vote. AYES: Supervisors J. P. Kenny*, A. M. Dias, T, J. Coll, L. A. Linscheld, J. S. Moriarty. NOES: Supervisors None. ABSENT: Supervisors None.
