HomeMy WebLinkAboutRESOLUTIONS - 01011969 - 69-13 RESOLUTION NO. 69/13 RESOLUTION APPOINTING ENGINEER OF WORK AND AUTHORIZING EXECUTION OF AGREEMENT BE IT RESOLVED by the Board of Supervisors of the County of Contra Costa, State of California, that LEPTIEN-CRONIN-COOPER, *Consulting Civil Engineers , be, and they are hereby, appointed Engineer of Work for the doing of all necessary engineering work and exercising all of the functions provided for the office of Engineer of Work and Superintendent of Streets under the "Improve- ment .Act of 1911" in connection with Assessment District No. 1969-1 , Roundhll Road, Contra Costa County, California; and BE IT FURTHER RESOLVED that the employment of said LEPTIEN- CRONIN-COOPER shall be as provided in the attache& agreement; and BE IT FURTHER RESOLVED that GUENTER K. LEPTIEN of the firm of LEPTIEN-CRONIN-COOPER be., and he is hereby authorized to sign all documents required to be signed by the Engineer of Work of said assessment district ; and BE IT FURTHER RESOLVED that the Chairman of the Board of Supervisors and the County Clerk of the County of Contra Costa be, and they are hereby, authorized to sign and attest the at- tached agreement employing the said LEPTIEN-CRONIN-COOPER as Engineer of Work for said assessment district . -2- 0%R I G3,1: A RESOLUTION NO. 69/13 I HEREBY CERTIFY that the foregoing Resolution was duly and regularly adopted by, the Board of Supervisors of the County of 'Contra Costa, State of California, at a regular meetinheld ern the 14th day of January, 195J, by the folloring vote , wit: AYES; Supervisors James-P. AGREEMENT THIS AGREEMENT made this 14th day of January, 1969, by and be- tween the COUNTY OF CONTRA COSTA, first party, and GUENTER K. LEPTIEN, FRANK J. CRONIN and JASPER COOPER, doing business as LEPTIEN-CRONIN-COOPER, a partner- ship, registered civil engineers, second party, WITNESSETH: That for and in consideration of the mutual covenants herein contained, ., the parties hereto agree as follows: 1. The COUNTY OF CONTRA COSTA proposes to initiate special assessment proceedings for Assessment District 1969-1 for the construction of Roundhill Road from .Stone Valley Estates to Miranda Avenue, and Garrydale Court as shown on the tentative map for subdivision 3836. 2. The COUNTY OF CONTRA COSTA, first party, hereby employs GUENTER K. IXPTIEN,, FRANK J. CRONIN and JASPER COOPER, second party, for the doing of all necessary engineering work under the proceedings to be taken in connection with the improvement work in said County of Contra Costa hereinabove described, and to be done in said County of Contra Costa. Said services shall include, but not be limited to, the following: A. Preparation for and furnishing of, all preliminary surveys, original plan drawings and specifications, and any and all other services which maybe required of- the Engineer of Work un- der the provisions of the proceedings to be taken. B. Preparation of right of way maps, descriptions, research, preliminary and right of way surveys and liason with utility companies relating to street lighting, underground utilities and water lines. C. Construction surveys and staking as follows: 1. Flag right of way line for clearing. 2. One set of stakes for rough grading. 3. One set of stakes for curb and gutter, sanitary sewers, drainage lines, sewer and drainage structures, underground utilities, lighting standards, water lines and water line structures. D. Preparation of exhibits, boundary maps, the engineer's report, assessment diagrams, calculations of assessment roll and bond description, and attendance at public hearings. 3. For said services, Leptien-Cronin-Cooper shall receive for. and as compensation the following sums of money: A. For services described in paragraphs 2 A and 2 B preceding, the sum of $11,500. B. For services described in paragraph 2 C preceding, the gum of $4,000 payable as follows: RESOLUTION 140. 69/13 .......................................... ............. ............................................. 1. $1,500 upon completion of right of way flagging and rough.,grade staking. 2. $2,500 upon completion of remainder of dark described in paragraph 2 C preceding. C. For services described in paragraph 2 0 preceding, the sum of $2,000 , payable upon adoption of the engineer's report and confirming of assessments by the County Board of Supervisors. All of said compensation 'shall be paid to Leptien-Cronin-Cooper by the County upon performance of the work in accordance with the foregoing, but only from assessment district funds when such funds are available to the County either from the sale of assessment bonds or advance of incidental, expenses from the Contractor. 4. Inspection of construction shall be a function of the party of the first past and no >responsib li.ty for or obligation thereto shall attach to the panty of the second part. 5. Costs of title reports, title insurance, right of way appraisals, right of way negotiations and acquisition, printing of plans, specifications, maps, exhibits and diagrams., soils investigations, laboratory tests, are not included within the compensation hereinbefore set forth. Any of such costs necessarily incurred shall be reimbursed as incidental expenses of the assess= ment proceedings. 6. Compensation for replacement of stakes and construction surveys ordered in addition to these outlined in paragraph 2 C herein and compensation for services outside the scope of this agreement shall be at the following per diem rates: Project Engineer $15.50/hour Computer-Draftsman $14.00/hour Twos-man Survey Party $30.00/hour Three-span Survey Panty $42.50/hour 7. it is understood and agreed between =the parties that Engineers are acting as independent contractors with the County and said Engineers agree to furnish evidence of professional liability insurance to be .maintained in full force and effect during the life of this agreement.
