In the matter of Proposed }
Federal Regulations Relating ) RESOLUTION ISO. 68/806
to Route Hearings for Federal
Aid projects.
WHEREAS the Federal. Highway Administrator recently filed.
rules in the Federal Register regarding public hearings and, the
process of locating and designing all. Federal-aid highways; and
WHEREAS said proposed rules would cover all Federal-aid high-
ways, including Federal-aid secondary, urban extensions, and other
highways under the jurisdiction of local agencies; and
WHEREAS said rules strike at the heart of the principles of
home rule and. effectively transfer control of location and, detailed
design fromm the local jurisdictions to the Federal Highway Adminis-
trator in Washington, D. C. ; and
WHEREAS the Federal, rules provide for unnecessarily lengthy,
involved and expensive proceedings; and
WHEREAS , while the public should be given the utmost opportun-
ity to be heard in such matters, highway improvements should not be
stayed by any 'individual or .group that disagrees with the majority
opinion; and
WHEREAS decisions as to the location and design of city streets
and county roads should. be made at the local level;
NOW$ THEREFORE, BE IT RESOLVED by the Board of Supervisors of
the County of Contra Costa that the Federal Highway Administrator is
REQUESTED to rescind immediately the proposed rules in the Federal
Register relating to the location and design of Federal.-aid. highways,
BE IT FURTHER RESOLVED that if the Federal Highway Administra-
tor does not make such rescission forthwith that the adoption of
the rules be delayed until a full and complete study can be made on
this subject to develop rules to provide for full public involvement,
but which would not violate the principles of home rule or allow
interminable delay by dissident persons or groups.
BE IT FURTHER RESOLVED that the County Clerk is directed to
forward six copies of this resolution to the Federal Highway Admin-
istration and a copy to the Director of the California Department
of Public Works, and to Senators Thomas H. Kuchel and George Murphy
and Congressman Jerome R. Waldle.
PASSED AND ADOPTED this 19th day of November, 1968 by the fol-
lowing vote of the Beard;
