County Disaster Office to proclaim the existence of a. State of F..mergency when said County is affected by such con- ditions as air pollution, fere, flood, tidal action, storm., epidemic, riot, earth*auke, or ether conditions except asa, result of war- caused disaster, which conditions are likely if unabated to give rise to a state of disaster or which conditions because of their magnitude are or are likely to be beyond the control of the services, personnel, equipment, and facilities of the responsible citizens or local agency of whatever designation, and require the forces of the County to combat; and ' H'E'a AS conditions of extreme peril to the safety of persons and property have arisen within the El Pueblo Housing Pro- sect and the area immediately adjacent thereto in said County caused by the following: 1. For a Long period of time there has been con- tinuous promiscuous discharge of firearms in said Housing Project. 2. Rocks, bottles and other missiles have been thrown at vehicles passing through said Housing Project. 3. In one recent attempt to apprehend a. criminal suspect on a warrant issued by the Superior Court of this County there was a coordinated attempt by persons in the area to assist the suspect to evade capture. The suspect was in the area for three days despite massive police efforts to capture him. The suspect was aided by groups of up to fifty people in his attempt to escape and gunfire was common throughout this area, by residents during this time. On one occasion about fifty (50) persons were on rooftops discharging firearms. 4. There has been vandalism to public facilities in said area. 5. 'dere has been harassment of public utilities employees to the extent that they only enter on a, restricted basis. 6. United States mail service has been interferred with in said area. RESOLUTION Nu BEK '68/519 7• Persons who lure outside the area could not enter the area without constant harassment by large groups of persons who congregated on the streets of said area. t3. There were threats to "burn the area down" on numerous occasions 9. Residents of the area have made numerous com- plaints to police agencies and have appeared before the Board of Supervisors to demand that they be allowed to live a, peaceful life. Said residents alleged that they could: not walk the streets of the area in safety and without harassment and that their children could not play can the streets of said axea. 10. Because of the aforementioned facts, additional police personnel were assigned to said area on April 15, 1968. 11. At 7:00 p.m. on April_ 16, 1968, officers of the Sheriff 's Department of this County, while on routine patrol., made several arrests in said area.. The police vehicle of said arresting officers was immediately surrounded by a large group of persons. Police vehicles entering the area were stoned by persons in the area. lifter the arrest incident, there was constant firing at police 'officers and two officers were. wounded as a result of said gunfire. There was, therefore, no effective law enforcement control, in said area that tt time. 12. That discharge of firearms and specifically shot- guns at law enforcement vehicles and personnel on July 31 has made effective law enforcement Impossible, That citizens and property within that area are in. danger of injury and damage from rocks, projectiles and gunfire and two citizens have been Tounded,t That the uncontrolled movement of people in said area, unnecessarily exposes such people to injury and damages That the streets and public ways of said area must be cleared of all persons, when their presence there is not necessary and such necessity has been determined by the Sheriff of Contra Costa. County; and 7dJE EAS this Board of Supervisors does hereby find that the aforesaid conditions of extreme peril did warrant and necessi- tate the proclamation of the existence of a State of ergency; and _RESC3�1UTION No. 68/519 WHERE-AS the Director of the Centra, Costa, County Disaster Office did oroclalm the existence of a. State of "emergency within said County at approximately 2 :30 a.-m- on the 31st day of July, 1968; and Wri,���EAS Section 3105-1 (a) allows the director of the Contra, Costa County Disaster Office to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by the Mate of Emergency and pur- suant to this authority the Director of the Contra. Costs, County D.sa.ster Office did make and issue the following regulations which are reasonably related to the protection of- life and property in the El :pueblo sousing .Brea:: 1. Not more than two -persons will be allowed to congregate in the streets of said area. 2. Law enforcement personnel may require identi- fication of any person in the area at any time. 3. A curfew is hereby established it the area from the hours of 10 :00 p.m. to 6:010 a.m. •:o person is to be on the streets of said area, without a special permit issued by the Sheriff of Contra. Costa County, during said hours. 4. Buildings and automobiles in the area. may be searched as necessary to protect citizens and law enforcement personnel when such buildings or automobiles have been reasonably determined by the :;sheriff to harbor a. person or persons throwing missiles, or discharging firearms; or ,I-hen missiles, projectiles or firearms utilized or intended to be utilised to endanger citizens in said area are reasonably knovan to the ;:sheriff to be contained in such buildings or autorm.obiles. w ... County Disaster Office are deemed to be reasonable and necessary for the protection of lives and property and are hereby confirmed and shall continue in force u:Mti.i rescinded.
