In the Matter of Senate Bill No. 916) RESOLUTION NO. 68/376
WHEREAS Senate Bill No. 916 would amend the California Vehicle Code
to permit increases in
(1) the allowable width of vehicles
(2) the allowed load per supporting component of vehicle
(wheel, axle, tandem axle) and
(3) the gross weight allowed per vehicle; and
WHEREAS$ the effect of such increases to be allowed on a road system
already deficient under current standards would increase the safety hazard on
narrow roads, and would increase the destructive effect of heavy loads on the
road system which is already seriously deficient as to structural capacity and
serviceability; and
14HERF.AS such increases would accelerate the rate of deterioration of
the road system unless the authority of public agencies is broadened to permit
control of such traffic using such road appropriate to the condition of the roads
and bridges and the need for such heavily loaded vehicles so that the public is not
inconvenienced and the public agency may upgrade the necessary routes for such
traffic in an orderly fashion commensurate with the availability of funds for such
necessary projects; and
WHEREAS the permitting of heavier loads without local administrative
control will generally disrupt any planned program for road improvement by local
agencies because of widespread and unpredictable events that could occur as
construction vehicles (as well as delivery vehicles) avail themselves of higher
load limits.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors opposes
the passage of Senate Bill 916 in its present form; and
BE IT FURTHER RESOLVED that the Board recommends that SB 916 (or
successor bills) include an amendment to Section 35707 of the Vehicle Code, to
read as follows:

highways and streets in an unincorporated area under the jurisdiction
of the Board of Supervisors without a permit issued pursuant to either
Section 36780 or Section 35791, only which by reason of damagecar

For the purposes of this section, an improved county highway means
a highway paved with cement concrete or asphaltic concrete, or a highway
with a hard surface not less than four inches thick made up of a mixture
of rock, sand, or gravel bound together with an artificial binder other
than natural soil.

AND BE IT FURTHER RESOLVED that F. R. Brown,, Chief Deputy
Public Works Director of Contra Costa County is directed to present
this RESOLUTION to appropriate legislative committees , and is
authorized to consult with the State Division of Highways , County
Supervisors Association, the League of California Cities, arxi other
interested parties in the matter of devising appropriate amendments
to SB 916 that will facilitate enacting mutually acceptable legisla-
tion beneficial to the public, the trucking industry, and local
governmental agencies in this matter.
