Congress of the United States
for Relief from Federal Court RESOLUTION NO. 68/348
Decisions Destroying Local
Residency Requirements for
certain Public Welfare
Recipients
Upon the recommendation of District Attorney John A. Nejedly ,
This Board RESOLVES AS FOLLOWS :
WHEREAS , in accordance with the laws of the United States ,
the County of Contra Costa has rea'uired continued residence for
a reasonable time as a condition for certain public welfare
payments , and
WHEREAS , recent federal court decisions in California and
in other states have determined some residency requirements to
be unconstitutional and threaten the destruction of all such
residency requirements , and
WHEREAS , it is reasonably estimated that the removal of such
residency requirements will cause the cost of public welfare to
this county to be increased at the expense of local property
taxpayers , and
WHEREAS ,, the bearing of such Increased costs by the taxpayers
of this county alone Is unjust and inequitable In that public
welfare expenditures to new residents reflect a benefit to the
states and counties from which they come and a benefit to the
nation as a whole in facilitating population mobility , now
THEREFORE , the Contra Costa County Board of Supervisors further
Petitions the President and Congress of the United States , in the
event that the Federal Government does not assume the cost of
public assistance payments required for recipients who do not meet
the presently permitted residence requirements , that federal
legislation be enacted to re-impose such residence requirements
or to permit their enactment and enforcement by the states ; and
be it further
F,ESO'.[JVED, That the Clerk of This Board transmit copies of
this resolution to the President and Vice President of the United
States , to the Speaker of the house of Representatives ,, to
RESOLUTION NO. 68/348
Renresent-at'-Ive Jerome Waldie , and to Senators Thomas Kuchel and
George Murphy .
