RESOLUTION FINDING AND DETERMINING THAT THERE IS A
SURPLUS IN THE FUND .PROVIDED FOR THE IMPROVEMENTS
MADE IN ASSESSMENT DISTRICT NO. 1966-4, COUNTY OF
CONTRA COSTA, STATE OF CALIFORNIA.
WHEREAS , it was provided in the proceedings for the
creation and consummation of Assessment District No . 1966-4,
County of Contra Costa, State of California, that any surplus
remaining in the improvement fund after the improvements were
completed was to be credited pro rata to each assessment levied,
in accordance with the provisions of the Municipal Improvement
Act of 1913 and the Streets and Highways Code of the State of
- California; and
WHEREAS , Section 10427. 1 of the Streets and Highways
Code of the State of California (being a portion of the Muni-
cipal Improvement Act of 1913) , under which said proceedings
were taken, provides that the surplus shall be refunded or
credited pro rata to the parties assessed as follows .
(a) Where an individual assessment, or any install.-
mens of the principal thereof, has been paid in cash, the credit
shall be returned in cash to the person or persons paying the
same upon their furnishing satisfactory evidence of payment ;
(b) Where all or any part of an individual assess-
ment remains unpaid, if said individual assessment is not pay-
able in installments , the credit shall be applied in its
entirety upon such individual assessment;

(c) Where all or any part of an individual assess-,
ment remains unpaid and is payable in installments , the credit
shall be pro rated by dividing said credit by the number of
principal installments remaining unpaid upon said individual
assessment and a portion of such credit so pro rated shall be
applied against any principal and interest installments there-
after due in the year such credit is ordered and in each year
thereafter; and
WHEREAS, the improvements have been completed and
the Engineer of Worm has filed a Final Engineer' s Cost Schedule
for said Assessment District No. 1966-4 , County of Contra Costa,
State of California; and
WHEREAS, there is a surplus in said fund for the im-
provements ;
NOW, THEREFORE, BE IT RESOLVED by the Board of Super-
visors of the County of Contra Costa, State of California, as
follows :
1 . The Final Engineer's Cost Schedule is hereby
approved and adopted as the final recapitulation of Costs for
said Assessment District No . 1966-4 , County of Contra Costa,
State of California, and all payments yet to be made shall be
made in accordance therewith;
2. There is hereby found to be a surplus in said
improvement fund in the amount of $19 , 157. 82 , which said surplus
is found by reference to the costs provided in the estimate
and amounts expended to date , as shown on the Final Engineer' s
Cost Schedule attached hereto as Exhibit A, which said Exhibit

A is , by this reference , incorporated herein and made a part
hereof;
3. The fund hereby declared to be surplus shall be
transferred to the Bond Redemption Fund of said assessment dis-
trict for the purpose of crediting the assessments or making
the refunds as hereinabove outlined; and
4 . The County Treasurer of the County of Contra
Costa is hereby directed to distribute the surplus from the
bond redemption fund of said assessment district to the extent
only of assessments or installments thereof heretofore paid in
cash, and to retain in the bond redemption fund the remainder
of said surplus against installments to become due in the
fiscal year 1968-1969 .
I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the Board of Supervisors of the County
of Contra Costa, State of California, on the 21st day of May,
1968 , by the following vote , to wit :
