HomeMy WebLinkAboutRESOLUTIONS - 01011968 - 1968-289 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Summary Abandonment of Portion of RESOLUTION No . 68/289 Hillcrest Avenue, County Road x#7564, Antioch Area (S&H Code 96o.1, 96o.4) and Conveyance of Abandoned Portion RESOLUTION ABANDONING A PORTION OF HILLCREST .AVENUE., COUNTY ROAD x'#7564, ANTIOCH AREA, AND CONVEYING THAT ABANDONED PORTION The Board of Supervisors of Contra Costa County RESOLVES THAT. A certain existing county road, known as Hillcrest Avenue (County Road No . 7564) , Antioch area, in the County of Contra Costa, has been surveyed by the County Engineer. Said survey disclosed some deviations from the record description of the road as described in the deed to Contra Costa County executed by Amos Graves, et al. , recorded on October 12, 1887, in Volume 53 of Deeds, page 103. The property owners abutting that section of road so surveyed have agreed that it would be for the best interest of the county and said abutting owners to correct the record location of the road and have therefore tendered to the county a Grant Deed dated July 20, 1956, from George J. Viera and others, for a 60-foot right of way for the road in its proper location. It is proper that any portions of said road as described in said deed (53 Deeds 103) which lie outside of the 60-feet- in-width boundary of the road as it actually exists today and determined by said survey be summarily abandoned as provided in Section 960.1 of the Streets and Highways Code and, in consideration of the convey- ance of July 20, 1966 to the county by George J. Viera and others, said abandoned portions be conveyed to the abutting property owners. Said abandonment will not cut off access to the property of any person which, prior to such survey, adjoined the highway. Any and all portions of said county highway known as Hillcrest Avenue within the Northwest 1/4 of Section 33, Township 2 North, Range 2 East, Mount Diablo Base and Meridian, described in said deed (53 Deeds 1.03) superseded by survey of the exact road location, which lie outside of the boundary of the parcel of land described in said deed from George J. Viera and others to Contra Costa, County, recorded herewith, but within the Northwest 1/4 of Section 33, Township 2 North, Range 2 East, Mount Diablo Base and Meridian, Contra Costa County, California be hereby ABANDONED. The Clerk of this Board is RESOLUTION No . 68/289 -1- hereby directed to cause a certified copy of this resolution to be recorded in the office of the County Recorder of the County of Contra v0StB. The Chairman of this Board is authorized and directed to execute quit claim deeds on behalf of the County of Contra Costa to the Present Title Owners of Record of properties adjacent to said abandoned portions of superseded road right of way.
