Wang and Bary H. lung ) ) } WHEREAS, it appears from the records of this Hoard, that the Contra Costa County Building Inspector acting as the *Enforcement Agency" pursuant to the provisions of Sections 17014 at seq., of Title DTIII of the California Admin- istrative d indm n istrative Code, having determined that the building Located. at 566 Tahoe Road Orinda , and more particularly described as Exhibit "All is unfit for human habitation or occupancy, and is therefore a public nuisance, and said Building Inspector having posted said property with N t ce tk Abat+s 14sance and having notified the owner (s) of said property that it is unfit for human habitation or occupancy, in the manner provided by law as appears more particularly from the declaration of the Building Inspector on file herein,; and WHEREAS, the said building has not been repaired or removed as re- quired by said Notice to Abate Nuisance; and WHEREAS, said Building Inspector thereafter posted said property with Notict2 AbLI& AULqS=, which Notice specified the time and place of the hear- ing before this Beard for the owners of said property to show cause why the building thereon should not be condemned as a public nuisance, and the Build- ing Inspector having notified the owners of said property of said hearing in the manner provided by law, as appears more particularly from, the declaration of the #14 2-65; 400 (Third Notice) RESOLUTION o. 68/57 3-Q-1689 Building Inspector on Pile herein; and WHEREAS, the matter hawing come on for hearing by this Board on Tuesday, Janwary 30, 1968 J. at 10 130 A.M./LXX. as provided in the Notice hereinabove mentioned; and WHEREAS, the owner of said pro ty barring appeared and having ro- quested a ional time within which to correo eficiencies of the said building and to a e the nuisance thereof, and the d having considered the matter and continue a hearing to Tuesday, , at A.M./P.M. WHERFAS# the Board having considered the evidence presented by said Building Inspector and all other interested parties, the following appears and this Board now finds that said building is unfit for human habitation or oc- cupancy by reason of the following deficiencies which are hereby Pound to exist: Extreme distortion due to earth movement. Approximately half of the structure has been removed. Considerable debris remains in the actual slide area, which has not been fenced to prevent entry or injury. 68 /57 #lea (Third Notice) 2 BE IT THEREFORE RESOLVED that said building is unfit for humn habita- tion or occupancy and is declared to be a pubic nuisance and the owners there- of are hereby ordered to abate said nuisance within 30 days after a copy of this Resolution along with Notice thereof has been posted to said property. BE IT FURTHER RESOLVED that it is the conclusion of this Board that said building cannot be reconstructed or repaired in a aanaer so as to comply with the provisions of Article 8 Chapter 9 of Title VIII of the California Administrative Code or the Centra Costa County Ordinance Code and therefore said building must be razed or rued, IT IS FURTHER ORDERED that the notice posted to said property shall specify that if said nuisance is not abated within the tie allowed, said nuisance will be abated by the Building Inspector of this Co»ntty, and the ex- pense thereof made a lien upon the land upon which said building (a) are located. EXCEPTING THEREFROM: The mineral rights reserved in the deed from East Bay Municipal Utility District, recorded May 16, 1957, Book 2982, Official Records, page 418, as .follows . "An undivided one-half (1/2) interest in and to all minerals, oil, other hydra--carbons, gas and all associated substances existing in or on said real property herein conveyed and hereinabove described together with the right to explore, drill for, extract, take from, remove and dispose of one -half (1/'2) of any or all said minerals, oil, other hydro--carbons, gas and all associated substances from said real property, below a depth of five hundred (500) feet from the surface thereof, by wells, equipment and means located on the surface of adjacent land and extended into said real property herein conveyed and hexeLnabove described at a point or points below a depth of five hundred (500) feet from the surface of said real property.
