HomeMy WebLinkAboutRESOLUTIONS - 01011968 - 1968-045 BEFORE THE BOARD OF SUPERVISORS of COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA In the Matter of the Proposed ) Abatement of the Property of RESOLUTION No. 6+8/45 Oscar A Carmine Wiley } WHEREAS, it appears from the records of this Board, that the Contra Costa County Building Inspector acting as the "Enforcement Agency" pursuant to the provisions of Sections 17014 st seq., of Title VIII of the California Admin- istrative Code, having determined that the building located at 105 Fairview Meet Pittsburg , and more particularly described as Sae Exhibit "A" is unfit for human habitation or occupancy, and is therefore a public nuisance, and said Building Inspector having posted said property with NoUce to Abate Nuisance and having notified the owner (s) of said property that it is unfit for human habitation or occupancy, in the manner provided by law as appears more particularly from the declaration of the Building Inspector on file herein; and WHEREAS, the said building has not been repaired or removed as re- quired by said Notice to Abate Nuisance; and WHEREAS, said Building Inspector thereafter posted said property with Nolic U AhLU AuLuau.. which Notice specified the time and pace of the hear- ing before this Board for the owners of said property to show cause why the building thereon should not be condemned as a public nuisance, and the Build- ing Inspector having notified the owners of said property of said hearing in the manner provided by law, as appears more particularly from the declaration of the #14 2-65; 400 68 /45 (Third ry Notice) 5-D-1523 Building Inspector on file herein; and WRFjMS, the setter hawing come on for hearing by this Hoard on Tuesday, January 23, 1968 i at10:30 A.M.11W as provided in the Notice hereinabove mentioned; and WHERRAS, the owner of said pr rty having appeared and having re- quested tional time within which to corre eficiencies of the said building and to to the nuisance thereof.. and the having considered the matter and continu hearing to Tuesday., s A.M./P.M. the owner of said props having appeared and having re- quested additional withip. vhich to correct ciencies of the said build- ing and to abate the nuisaa thereof, and the Board he considered the matter and continued the hearing to esday at A.M./P.M. WRMEAS, the Hoard having Pusidered, the evidence presented by said Building Inspector and all other interested parties, the following appears and this Board now finds that said building is unfit for k=mn habitation or oo- cupancy by reason of the following deficiencies which are hereby found to e►xista 1. Lack of room and space dimensions required by this Code. Violation of Uniform Housing Code, Section H-1001 (b) 9. 2. Deteriorated and inadequate foundations. Violations of Uniform Housing Cade, Section H-1001 (e) 1. 3. Flooring supports of insufficient size to carry imposed loads with safety. Violation of Uniform Housing Cade, Section H-1001 (c3) 3. 4. General dilapidation and unproper maintenance. Violation of Uniform Housing Code, Section H-1001 (b) 13. S. Is an attractive nuisance which may prove detrimental to children. Violation of Uniform Housing Code, Section H-1001 (d). 6. Hazardous wiring installed in an unapproved manner. Violation of Uniform #14 Housing Code, Section H-1001 (a). 2-651 400 (Third Notice) 68/ 45�n � � .• C? 4h 2 BE IT THEREFORE RESOLVED that said building is unfit for human habits- tion or occupancy and is declared to be a public nuisance and than owners there- of are hereby ordered to abate said nuisamoe within 30 days after a copy of this Resolution along with Notice thereof has been posted to said property. BE IT EORT&M RESOLVED that it is the conclusion of this Board that said building cannot be reconstructed or repaired in a canner so as to comply with the provisions of Article 8 Chapter 9 of Title 'VIII of the California Administrative Code or the Contra Costa County Ordinance Code and therefore said building must be razed or removed. IT IS FURTHER. ORDERED that the notice posted to said property shall specify that if said nuisance is not abated within the time allowed, said nuisance will be abated by the Building Inspector of this County, and the ex- pense thereof made a lien upon the land upon which said building (s) are located.
