BEFORE THE BOARD OF SUPERVISORS OF COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA In the Matter of the Proposed ) Abatement of the Property of ) RESOLUTION 67/531 William 'R:. & Evelyn Zuf a ll � } ) WHEREAS, it appears from the records of this Board, that the Contra Costa County Building Inspector acting as the "Enforcement Agency" pursuant to the provisions of Sections 17011+ st seq., of Title VIII of the California Admin- istrative Cade, having determined that the building located at 1541 Donald Avenue fart3tez , and more particularly described an See Exhibit A is unfit for human habitation or occupancy, and is therefore a public nuisance, and said Building Inspector having posted said property with notice to Abatr� Nu seance and having notified the owner (s) of said property that it is unfit for human habitation or occupancy, in the manner provided by .law as appears more particularly from the declaration of the Building Inspector on file herein; and WHEREAS, the said building has not been repaired or removed as re- quired by said Notice to Abate Nuisance; and WHEREAS, said Building Inspector thereafter posted said property with Natic _t2 Ab&&S SU , which Notice specified the time and place of the hear- ing before this Board for the owners of said property to sham cause why the building thereon should not be condemned as a public nuisance, and the Build- ing uilding Inspector having notified the owners of said property of said hearing in the manner provided by lax, as appears more particularly from the declaration of the #14 2-65; 400 (Third Notice) `6 7A 3 1 Building Inspector on file herein; and WHEREAS, the matter having came on for hearing by this Board on Tuesday, A+a`... o._2ugt 1. 1967 at tj= A.M. .& as provided in the Notice hersinaabove mentioned; and WHEREAS, the owner of said property ?saving appeared and havi +�- quested additional tine within which to correct deficiencies o e said building and tars abato,.the nuisance thsroof; aand the having considered the matter and continued the" srri.ng to 'facet at A.M.f P.M. ~" WHEREASp thea owner of a,�',propertIn ppeareed and having re- quested. additional tune y�t which tea core es of the said build- lat to abate nuisance thereof, and having ' tired the matter�anontixaueaed the hearing to Tuesday : A 7p� y,� A.M.rF.Me WHEREAS$ the Board having considered the evidence proo*nted by said Building Inspector and all other interested parties, the following appears and this Board now finds that said building is unfit for human habitation or oc.- cupancy by reason of the following deficiencies whiah are hereby found to ext.stz 1. Inadequate sanitation. (a) Lack of plumbing fixtures. Violation Umbra Housing Code, Section H 1001 (b) 1, (b) Lack of proper heating facilities. Violation Uniform Housing Code, Section H 1001 (b) b, (c) Look of minimum amounts_of natural light and ventilation. Violation Uniform Housing Code, Section H 1001 (b) 8, 2, Inadequate and deteriorated foundation* Violation Uniform Housing Code, Section H 1001 (c) 1, 3, Broken and buckled exterior masonry block walls with insufficient reinforcement, Violation Uniform Housing Code, Section H 1001 (c) 4, 4, Electric wiring has not been maintained in gonad condition and is unsafe. Is an attractive nuisance which may pTovs detrimental to children, Violation Uniform Housing Codes, Section H 1001 (d) (b), #l4 2-.65; 400 (Third Notice) 2 6 7/5 3 BE IT THERVORE RESOLVED that said building in unfit for human habita- tion or occupancy and is declared to be a public nuisance and the owners there- o f are hereby ordered to abate said nuisance within 30 days after a copy of this Resolution along with Notice thereof has been posted to said property. BE IT FURTHtR RESOLVED that it is the conclusion of this Board that said building cannot be reconstructed or repaired in a manner so as to comply with the provisions of Article 8 Chapter 9 of Title VIII of the California Administrative Code or the Contras Costa county Ordinance Coder and therefore said building must be razed or rammed, IT IS FURTHER ORDERED that the notice posted to said property shal1 specify that if said nuisance is not abated within the time allowed, said nuisance will be abated by the Building Inspector of this County, and the ex- pense thereof made a lien upon the land upon which said building (se<) are located.
