In the Matter of Establishing Policy for Uniform Minimum ) Standards for Commercial ) RESOLUTION NO. 67/442 Aeronautical. Activities on } Buchanan Field Airport . } WHEREAS Buchanan Field Air-port at Concord., California, is awned by the County of Contra Costa and is operated under the policy direction and control by the Board. of Supervisors , and 1UHEREAS in the public interest for the purpose of developing and maintaining essential airport services and facilities, this Beard has established uniform minimum standards for the conduct of co-=ercial activities on Buchanan Field; and 14HEREAS lessee/developers are encouraged to operate, either directly or through sublease arrangements, a. combination of aeronautical activities which will be of benefit to the Airport and its patrons; NO14, THEREFORE, BE IT RESOLVED that the following policy for minimum standards for commercial aeronautical activities on Buchanan Field Airport are hereby ESTABLISHED 1. Lease Ground Plot -- 200 ' x 220t or 44,000 sol. ft . 2. Rental : The actual lease ground rental is deter- by open co apeti.t ive bidding procedure. a. 2 � per square foot minimum ground ',rent. b. The actual lease rent also includes 1% of lessee's gross monthly receipts of 'a.l.l aviation operations except wholesale sales and sales of new and used aircraft ',and v�ji.th certain other exceptions . c . Flowage fees of 3� per gallon on all gasoline sales up to and. including 300,000 gallons per year. For all gasoline sales in excess of 3€0,000 gallons per year, lessee shall pay Sig per gallon. A flowage fee of 5X per gallon is paid for lubricating oil..' d. Lessee pays to lessor 10 of gross receipts received by lessee for car rental. RESOLUTION NO. 67/442 e. Periodic revaluation (every 5 years ) of mininum rent to protect both lessor and lessee during long-tern lease period, 3 . IM'I rovements . Minim-an building size of l2,000 sq. ft. with other improve�fents must have Countyarchitectural plan approval, and,:, must meet construction completion . Performance : Lessee must show evidence of financial stability by producing a financial statement accept- able to Contra Costa County, and in addition must provide the County with the fallowing. a. A bid deposit of $1,000 which is returned to lessee upon posting performance and. material/labor bonds for construction of the plan approved building, or forfeiture upon non-perfonnance . . Insurance : Lessee must procure and maintain public liability insurance .for bodily injury in the amount of $25 x s OOO for one person and $5000000 for two or mare persons and property damage insuranae in the amount of $50,000- 6. 50,OOC}w6. Uses : Lessee is privileged to use the Airport in common with others and to conduct operations on the leased premises under definition of fixed.' base operations, which primarily include but are not limited to the followings aircraft sales' and rentals, aircraft maintenance and repairs, air- craft accessories sales and repairs, aircraft fuel sales and servicing, air taxi operations , aerial photography, flight training, car 'rental (non-avi at ion) . 7. Non discrimination: Lessee raust rake his services available to the public without unjust discrimination as to race, color or creed and must not levy exc;es- sive or unreasonable charges for use of his facilities .
