Costa, California, that the Chairman of the Beard of Super- visors be authorized to sign and the County Clerk be authorized to attest, that certain agreement between the East Bay Municipal. Utility District and the County of Centra. Costa, which said agreement is attached hereto. BY Barbara Hemp Deputy 0 R I C 1 I A L • Y _ _ .. k AGREEMENT THIS AGREEMENT, by and between the COUNTY OF CONTRA COSTA., hereinafter caped "County", and the EAST BAY MUNICIPAL UTILITY DISTRICT, hereinafter called "District"; WHEREBY IT IS AGREED, 1. County is presently undertaking assessment proceedings for the doing of certain work and improvements which will -include certain water mains, appurtenances and facilities for the supply and distribution of a. domestic water supply in certain streets within the boundaries of Assessment District No. 1967-1, County of Contra Costa, State of California, pursuant to the provisions of the Municipal Improvement Act of 1913. 2. County, pursuant to the provisions of the foregoing statutes, has requested District to furnish plans and specifica- tions for adequate and appropriate water .reins and appurtenances within said Assessment District. District agrees to furnish and submit to County said plans and specifications and ;County agrees to adapt same and incorporate said plans and specifications into its plans and specifications for doing, the aforesaid work, and said water mains and appurtenances shall be installed in accord- ance therewith. 3. District may at all times maintain an inspector over the work to see that the plans and specifications have been com- plied with,, and County and the Engineer appointed by the County to act as Engineer of said Assessment District shall cooperate with the District and its inspector in all duties incident to design and construction. After completion and acceptance of the work, County will cooperate with District in the enforcement of any guarantees made by the contractor in contractor's agreement to perform the work. The engineering and inspection costs shall form a part of -the incidental expenses. It is herewith agreed that the cost jjfjjj 3 of said inspection and engineering shall be the sum of EIGHT HUNDRED EIGHTY AND 75/100 DOLLARS ($880.75), and County agrees to include said sum as Incidental Expenses under the aforemen- tioned assessment proceedings. 4. District, for the sum of NINE THOUSAND THREE HUNDRED FOUR AND 25/1.00 DOLLARS ($9,3x4.25), will furnish pipe and materi- als of' construct on, including four (4) 5-inch hydrants, as—pro- vided for in Paragraph 2.1 of said plans and specifications, and will install thirty (30) 5/8--inch x 3/4-inch services and two (2) f--inch fire hydrants. Said sum shall be paid to District in ad- vance by the contractor who is awarded the contract for doing the work. 5. After the work has been completed and accepted by Engineer and District, all mains, facilities and appurtenances installed pursuant to plans and specifications shall become the property of District and pari of its system, to be operated, maintained and managed by it as a part of such system under the , rules and regulations and subject to the rates and charges of District from time to time established. 6. District shall not be obligated to extend without charge its mains and facilities within the boundaries of said Assessment District, and any future extension of .mai.ns, facilities and appur- tenances beyond those specifically set forthh in the ',plans and specifications shall be under the rules and regulations and subject to the rates and charges from time to time established by District. 7. Wherever the mains, facilities and appurtenances to be installed hereunder are not installed In dedicated County roads, County shall provide the necessary rights of way, tank and pumping ' plant sites, and other property necessary to installsaid. works as provided for in the plans and specifications, and where required, County shall execute and deliver to District appropriate instru- ments of transfer and such other documents as District may require to convey to the District said rights of way, sites and other property. -2- 6 7'12 3 a 8. Except as specifically provided for herein, District shall in no case be liable for any portion of the expenses of the work or of the proceedings connected with the construction if improvements in said Assessment District .
