RESOLUTION FINDING AND UETEI:'11INING THAT THERE 1S A SURPLUS IN THE FUND PROVIDED FOR THE 111PROVEMIENTS AND ACQUISITIONS IN ASSESSMENT DISTRICT NO. 1964-4, TRACT 3306, COUNIT OF CONTRA COSTA STATE OF CALIFORNIA WHEREAS, it was provided in the proceedings for the creation and consummation of Assessment District No. 1964-4, Tract 3396, County of Contra. Costa, State of California_, that any surplus remaining in the improvement fund after the improvements were cor.- pleted was to be credited prorata to each assessment levied, in accordance with the provisions of the Municipal Improvement Act of 1913 and the Streets and Highways Cone of the State of California; and WHEREAS, Section 10427 .1 of the Streets and: Highways Cade of the State of California, (being a portion of the Municipal Improvement Act of 1513) , under which said proceedings were taken, provides that the surplus shall be refunded or credited prorates to the parties assessed as follows: (a) Where an individual assessment, or any installment of the principal thereof, has been paid in cash, the credit shall be returned in cash to the person or persons paying the same upon their furnishing satisfactory evidence of payment; (b) Where all or any part of an individual assessment remains unpaid, if said individual assessment is not payable in installments, the credit shall be applied in its entirety upon such individual assessment; (c) Where all or any part of an individual', assessment remains unpaid and is payable in installments, the credit shall be prorated by dividing said credit by the number of principal installments remaining unpaid upon said individual assessment and a portion of such credit so prorated shall be applied against any 6717 0 principal and interest installments thereafter due in the year such credit is ordered and in each year thereafter, and WHEREAS, the improvements and acquisitionshave been completed and the Engineer of Work has filed an Engineer's Final Recapitulation of Casts for Assessment District No. 1964-4, Tract 3306, County of Centra Costa, State of California; and WHEREAS, there is a surplus in said fund for. the improve- ments and acquisitions; NOUT, '. HEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Contra Costa, California, as follows: 1. The Engineer's Final Recapitulation of Costs is hereby approved and adopted as the final recapitulation of the costs of improvements and acquisi I HEREBY CERTIFY that the foregoing Resolution was duly and regularly adopted by the Board of Supervisors of the County of Contra Costa, State of California, at a regular westing thereof, held can the 7th day of March, 1967, by the following vote* to wits AYES: Supervisors James P.
