COSTA, AND DIVIDING AND DISTRICTING SAID COUNTY INTO LAND USE DISTRICTS, PROVIDING REGULA- TIONS FOR THEENFORC.EIENT. THEREOF, .NPENALTIES FOR THE VIOLATION OF THIS ORDINANCE", PROVIDING :FOR MODIFICATION OF THE RE ,UIREMENTS OF THE FORES- TRY RECREATION DISTRICT, THE ESTADLISM NT OF A REAR. YARD REgUIREMERT IN RESIDENTIAL DISTRICTS, REGULATING THE SIZE OF REAL ESTATE SIGNS AITJD 1140- DIFLYING THE REQVIRK.1ENTS FOR SIDE YARDS IN RESI- DENTIAL DISTRICTS ANT MODIFYING THE REGULATIONS FOR SUBDIVISIONS IN AGRICULTURAL DISTRICTS. The Beard of Supervisors of the County of Gontra Costa, Stats of California, do ordain as follows: SECTION 1.. Subdivision R of Section 4 of Ordinance No 382 is hereby amended as follows; Subdivision H, FORESTRY RECREATION DISTRICT -- (Map Designation F-R): All of the land lying within a forestry recreation district may ,be used for any of the following uses, and the use thereof is subject to the fallowing regulations: Subsection 1. All of the uses permitted in single family residential districts, agricultural districts, and transition resi- dential agricultural districts, together with such uses as are per- mitted by the provisions of this ordinance after the granting of landuse permits for the special uses authorized to be granted in any of the said districts. Subsection 2., For public and private parks and play grounds, summer homes, hotels, golf courses, organized recreational camps, residences, temporary and seasonal.' clubs and: camps and for other recreational uses. Land use permits may be granted upon proper application for the following uses in recreational districts: (a) gift shops, 1. (b) tea rooms. Subsection 3. Lot area: All buildings., or parts of buildings, hereafter erected or altered for use as single family dwellings, shall in forestry recreation districts have a lot area of not less than one-half ( 1/2') acre, and all such lots shall have an average width of not less than. eighty (80) feet. Subsection 4. Height: No building or structure, or part thereof, hereafter erected for use in a forestry recreation dis- trict, shall be more than. four (4) stories in height, or more than. fifty (50) feet in height. Subsection 5. Side Yards: There shall be a side yard on each side of each building in a forestry recreation district she aggregate'' width of such side yards shall not be less than thirty- five (35) feet, and no side yard shall be less than fifteen (15) feet for each building. The depth of the rear yard of any lot on which a summer home is erected or altered shall not be less than fifteen (15) feet. Subsection 6, Set Backs. No structure erected in a for- estry recreation district, and no accessory= structure thereto, shall be located nearer than twenty-five (25) feet from the boundary line of any existing public read or highway. Land use permits for the special uses enumerated in Subsection 1 of this Subdivision and to modify the provisions con- tained in: Subsections 3, 4, 5 and 6 of this Subdivision may be granted after application therefor in accordance with the provisions of this ordinance. SECTION 2, Section 9 of Ordinance No. 382 is hereby amended by the addition of a Subsection 11 at the end thereof: Subsection 11. In all single family residential districts (reap designation R-1)_, multiple family residential, districts (map designation MR) , multiple family residential districts A (map designation -R-A) , residential suburban districts (map designation 2. R-S) , transition residential agricultural districts (map designation R-A) , and suburban districts (map designation S) , there shall be a rear yard of not less than five (5) feet wherever rear yards of any lot, lots, or parcels of land abut on side yards. SECTIO' 3, Subsection 16 of Section 2 of Ordinance No, 382 is hereby amended as follows: Subsection 1 "Outdoor advertising" means Outdoor Advertising., means any sign of any kind or character whatsoever, placed or erected outdoors on any natural or constructed object,, including any struc- ture or thing upon which any such sign is placed or affixed, except small signs indicating ownership of property or advertising such property for purposes of sale, which signs are actually placed or affixed upon the property owned or offered for sale. Signs adver- tising properties for purposes of sale shall not be greater in size than twenty-four (24) square feet, shall not exceed ten (10) feet in height, and shall be permitted only after first having obtained a land use permit therefor in accordance with the provisions of Section 7 of this Ordinance and for a period not to exceed eighteen (18) months, SECTION 4. Subsection 1 of Subdivision E of Section 4 of Ordinance No, 382 is hereby amended as follows,* Subsection 1, All of the uses permitted in suburban districts, transition residential agricultural districts, residen- tial suburban districts, and forestry recreation districts., together with such uses as are permitted by the provisions hereof after the granting of land use permits for the special uses authorized to be granted in any of said districts. Provided, however, that all subdivisions In agricultural districts shall, before approval by the Planning Commission, be heard by said Commission at public hearings after due notice thereof in a similar manner to the provis- ions for the hearing of applications for land use permits as set forth in Section 7s and in conformity with the Subdivision Map- Act, SECTION 5, Ordinances Nos. 407 and 472 of the County of Contra Costa are hereby repealed, Section 9 of Ordinance No. 382 is hereby amended by the addition of a Subsection 12 at the end thereof as follows: Subsection 12. NotWithstanding any other provisions of this ordinance, side yards shall be permitted in any suburban district, transition residential agricultural district, residential suburban district, single family residential district, multiple family residential. district, multiple family residential distriot-A, according to the following table for any lot or parcel of land which said lot or parcel of land was. established by records in the office of the Recorder of the County of Contra Costa prior to the effective date of The Zoning Ordinance of the County of Contra Costa, being Ordinance No. 382 and amendments. thereto, for the area or district in which said lot or Darcel of land is situated: FRONT WIDTH ITINIMMI, AGGREGATE MINIMUM SINGLE OF SIDE YARD SIDE YARD LOT ALL MIM ALLOWED feet or less but amore than so feet 20 feet 10 feet - 80 feet or less but more than 51 feet 15 feet 5 feet 51 feet or less but more than 41 feet 10 feet 5 feet 41 feet or less but more than 31 feet 8 feet 3 feet 31 feet or less 6 feet 3 feet SECTION 6. This ordinance shall take effect and be in force from and after thirty (30) days after the date of its pas- sage and adoption, and the sane shall be published once before the expiration of fifteen ( 15) days after the date of its passage and adoption, with the names of the members voting for and against the same in the "CONCORD TRANSCRIPT" a newspaper of general circulation, printed and published in the County of Contra Costa, State of California, Adopted by the Board of Supervisors of the County of Contra Costa State of California, on the �th day of J)aly 4. ............ ...... 1949, by the following vote: AYES: Supervisors S.
