AM TM=10 A MCENSE ra POR THE ISSUING OF PERUITS THEREFOR. The Board of Supervisors of the County of Contra Costa, State of California, do ordain as follows'* SECTION 1. Every person conducting,, managing, operating, or carrying on any transient fair, carnival, Terris-wheel, scenic- railway, merry-go-round, swing, ehute-the-chutes, open-air amuse- ment device, traveling theatrical or show or other like and similar exhibition and amusement within the county of Contra Costa, State of California, shall first obtain a permit from the Board of Super- visors thereof to hold or conduct the same, and shall pay in advance the following license fee: Seventy-five ($75.00) dollars per day, plus an additional five ($5.00) dollars per day for each and every separate show, conces- sion, attraction or exhibition, every ride or amusement device of any kind, and any other attraction or exhibition where any admission fee or any charge whatsoever is imposed upon the patrons of said at- traction or exhibition, when any of the same is carried on or con- ducted in conjunction with said fair, carnival, or other attraction hereinabove referred to. SECTION 2. Any person, firm or corporation,, maintaining, conducting or operating any transient fair, carnival, Ferris-wheel, scenic-railway, merry-go-round, swing, chute-the-chutes, open air amusement device , traveling theatrical or show or other like or sim- ilar exhibition or amusement without first securing a permit as here- in provided and without paying the license fee as herein provided, shall be guilty of a misdemeanor and upon conviction thereof shall be pun- ishable by a fine not exceeding Five Hundred (4500.00) dollars, or by imprisonment in the county jail of the County of Contra Costa, State of California, for a period not exceeding six (6) months, or by both such fine and imprisonment. 1. .............-- SECTION 3. It is hereby further provided that the Board of Supervisors, upon hearing application for permit may remit any license fees herein provided and authorize the issuance of a permit without license fees in the event that any of the shove designated exhibitions or amusements herein referred to are given or are spon- sored by organizations whose principal purpose is charity or edu- cational benefits, or civic purposes or general welfare and public interests. SECTION 4. For each dap that any person, firm or corpor- ation shall maintain, conduct or operate any of the said amusement devices as herein provided, in violation of this ordinance, it shall constitute a separate offense and it shall be punished as a separate infraction as herein provided. SECTION 5. No portion of any public street, roadway, or highway shall be used for the purpose of conducting any such faire, carnival or other exhibition or amusement in this ordinance referred to, unless special permission is secured and that portion of a public street, roadway, or highway permitted to be so used shall be speci- fioally designated within said permit as being granted to the appli- cant for such use. SECTION B. Ordinance No. 225 entitled, "An Ordinance Re- quiring the Licensing of all Carnivals, Fairs, or Traveling Show► Within The County of Contra Costa, State of California, and Requiring a License Tax for the Issuing of Permits Therefor", is hereby re- pealed. SECTION 7. If any section or sub-section, sentence, clause, phrase or words of this ordinance for any reason is held unconstitu- tional or invalid, the decision holding the same unconstitutional or invalid shall not affect the validity of the remaining portions of this Ordinance. The Board of Supervisors hereby declare that they have passed this Ordinance and each section, sub-section, sentence, clause, phrase, and word thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or words be declared unconstitutional or invalid. 2: SECTION 8. This ordinance shall take effect and be in force from and after the 5th day of May, 1947, and before the expiration of fifteen (15) days after the passage hereof, it shall be published with the names of the members voting for and against it for one (1) week. in the "V _ ALLFZ EjQXEEg" a newspaper of general circulation published in the said County of Contra Costa, State of California.
