PROHIBITING INTERFERENCE ENC WITH THE DUTIES Off' FIR31M AND FIRE EQUIP T, IZGULATING PANG AT FIMS, AND PROVI . I NG PENALTIES FOR VIOLATION'S OF ANY OF THE PROVISIONS THMOF. SECTION I. It shall be unlawful for any parson, firm, co- partnership, association, or corporation to throw, place, or permit to stand on any land within the said Mt. View Fire Protection District, any rubbish, tree cuttings, or other inflamable material. SECTION IS. It shall be unlawful for any person, firm, co- partnership, association or corporation to build, light, maintain, or cause or permit to be built, lighted or maintained any fire within the said Mt, View Fire Protection District between the hours of nine o'clock A.M. and five o'clod P. + of each day between the period of May 15th and .November 15th of each year, CTION III. It shall be unlawful for any person, firm, coo- partnership, association or corporation to permit or allow any fire burn- ing after sunset or before sunrise. SECTION IV. It shall be unlawful for any person, firm, co- partnership, association or corporation to build, light, maintain or cause or permit to be built, lighted or maintained any open or outdoor fire at a distance within one hundred (100) .feet of any building or inflamable structure in the Mto View Fire Protection District of the County of Contra Costa, State of California, without a written permit first granted by the Chief of the Fire Department of the said Mt. view Fire Protection District of the County of Contra Costa, State of California; provided, however, that such permit is not necessary for the burning of any flamable material in an incinerator oo nstructed of non-combustible material, completely en- closed and equipped with a spam arrester of wire, metal screem car equiva- lent, having a mesh or holes not to exceed one-quarter (1/4) inch,, or any l: spam arrester which is designed to provide theequivalent protection. SECTION V. It shall be unlawful for any person, firm, co- partnership, association or corporation, to leave, or cause or permit to be left, any outdoor or open fire unattended by any adult person in the said Wt. View Fire Protection District of the County of Contra Costa, State of California. Before leaving any such fire, such person or per- sons in charge of such fire shall thoroughly extinguish same by completely covering; it with dirt, saturating it with water„ or otherwise treating it in such manner to prevent rekindling of such fire. SECTION VI. It shall be unlawful for any person, firm, oo- partnership, association or corporation to place or maintain, or to cause or permit to be placed or maintained, any obstruction, whether permanent or movable, before or upon any fire escape, exit, foyer, aisle, passage- way, corridor, or any other means of egress from any theatre, church, hospital, auditorium, meeting hall, or other place used for public assem- blage, while open to the public, in the said Mt. View Fire Protection District of the County of Centra Costa, State of Ualifornia. No persons shall be allowed to stand or assemble in the aisles or passageways, during any time while any of the aforesaid described buildings or places are being used for public assemblage. All exit doors of such buildings or places shall open out and during the use of such a building, or place, for public assemblage, shall not be fastened in any manner except by self-releasing hardware installed thereon, which doers and hardware shall be maintained to open freely. SECTION VII. It shall be unlawful for any person, firm, coo-partner- ship, association or corporation to accumulate, or to cause or permit the accumulation of rubbish, rags, paper or other inflamable refuse in any theatre, church, hospital, auditorium, meeting hall or other place used for public assemblage in the said Mto View Fire :protection District of the County of Contra. Costa, State of California, in such manner as to constitute a fire menace. SECTION V III. It shall be unlawful for any person, oo-partnership, firm, association or corporation to disobey the lawful orders of any 2. public officer or fireman in the imediate vicinity of the burning of brush, stumps, lags, fallen timber, fallows, slash, grass, grain, brush or forest covered land, or any other inflamable material in the said t. view Fire Protection District of the County of Contra Costa, State of California, or coffer any resistance to or interfere with the lawful efforts of any public officer, fireman or company of firemen, to extinguish the same, or engage in any disorderly conduct calculated to prevent the same from being extinguished, or forbid, prevent or dis- suade others from assisting to extinguish the same. SECTION IX. It shall be unlawful for any person, firm co-partnership association or corporation to ride, drives or propel any vehicle or convey- ance upon, over or across any fire hose or chemical hose used by or in charge of any fireman or company of firemen in the said Mt. View Fire Protection -District of the County of Centra Costa, State of California, or to injure or damage in any manner any such hoses or fire apparatus of any kind„ SECTION X. It shall be unlawful for any person, firm, co-partner- ship, association or corporation to park any vehicle upon any street or highway within three hundred (300) feet of any burning building, or other burning structure, in the said Mt, View Fire Protection District of the County of Contra Costa, State of California, provided, however, that this section shall not apply to vehicles of police of'f'icers, firemen or any fawner, tenant or other occupant of such building or structure, or any authorized agents of such owner, tenant or other occupant, SECTION XI. .any person, firm, oo-partnership, association or corporation violating any of the provisions of this ordinance shall be guilty of a misdemeanor and shall upon conviction be punished bey a fine not exceeding Five Hundred Dollars 4500,00) or by imprisonment not ex- ceeding six months or by both such tine and imprisonment, Ivery separ- ate act or transaction in violation of this ordinance shall be deemed a separate offense* 3• ............ ..... This ordinance shall take effect after the same shall have been posted in three (3) of the most public planes in the said Mt, View Fire Protection Distriot for a period of two (2) creeks. Smith being duly sworn, says that he is and at all times hereinafter mentioned was, a citizen of the United States, over the age of twenty-one years and not in- terested in the matters set forth herein; that on the 19th day of April, 1945, he posted three true and correct copies of the annexed Ordinance No. 340, being an ordinance of the Mt. View Fire Protection District of the County of Contra Costa, State of California , establishing regulations pertaining to fires and fire menaces, prohibiting obstructions to means of egress and accumulations of rubbish in places of public assem- blage, prohibiting interference with the duties of firemen and fire equipment, regulating perking at fires, and providing penalties for violations of any of the provisions thereof, at the following locations, to-wit : (1) On poiNer pole on south side of Pacheco Road 10 feet west of entrance to Vine dill School. (2) On south end of Idt. ,View fire House facing Peach Street. (3 ) On power pole on east side of Palm Avenue at in- tersection of Martinez Ave. and Palm Avenue at Mt.
