S.ZOTI N 1 Sai It shall be mandatory upon all incorporated towns or municipalities or other governmental agencies and upon all public or private agencies of unincorporated areas within the said county who apply ,for permits to use the said garbage disposal site to file with the Board of Supervisors of said County a bond in the amount of Five Thousand Dollars ($5,000.00) , which said bondshall be for the purpose of guaranteeing that all garbage dumped by any one of the agencies above described must be ,properly ;filled and covered''' by that said agency and must be disposed of at said garbage disposal site in a sanitary and sightly manner, and in accordance with the rules and regulations promulgated by the County Health Department (a') Properly filled' and covered shall be defined as covered with a' layer of earth tura feet (2 ft. ) in depth., every seventy-two (.72) hours. SECTION 2: It shall be:, unlawful for any person or persons, firm, associ.ati.oii or corporation, without first' having obtained from the :,Board of Supervisors of the County of Contra Costa written permit so ' to do (a) To transport or cause to be transported along and upon the public streets, roads and highways of the County of Contra Costa,' any garbage,' house refuse, sill, butchers' offal, putrid or stinking animal or 'vegetable :matter or other like matter; (b) To rent, lease,' hire, keep or maintain any pace, ' land or ',prem- ises within: said, County of Contra Costa for the purpose of depositing or dumping thereon garbage,' house refuse, swill, '. butchers' offal, putrid or stinking vegetable or animal' matter, or other' lips matter of dead animals; (c) To deposit or dump in and upon any place or upon any lands or premises in said County or to throw or dump, or cause to be thrown or dumped into any tide eaters, lakes, streams or reservoirs within said County, any garbage.., house refuse, shrill, butcher's' of'f'al, putrid or stinking vege- table animal matter or ether like ratter.' (d) To allow or permit to remain upon any land or premises under his, her, their or its control any garbage, house refuse, swill, butchers' offal, ,putrid or stinking animal or vegetable matter, or other like matter, or any bones or old or filthy rage.' J SECTION . Any person or persons, firm, association or corporation violating the provisions of this ordinance, or any part thereof, shall be punished by a fine not exceeding 'Five' Hundred Dollars '($500.00) or by im- prisonment in the County Tail not exceeding six months, ,or by both such fine and. imprisonment. SECTION 4: All ordinances in conflict with the foregoing ordinance are hereby 'repealed. SECTION 5: If any section, '.subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such de- cision shall not affect the validity of the remaining portion of this ordinance. The Board of Supervisors of the County of Contra Costa 'hereby declares that it would have passed each provision of this ordinance' ir- respective of the fact that one or more sections, subsections, sentences, clauses' or phrases, ;.or portions thereof, be declared unconstitutional. SECTION 6: This ordinance is hereby' declared to be an emergency measure necessary for the immediate preservation of the public health and safety, and shall take ef=fect and be in force from and after its passage and publication as required by law.
