Any person or persons, eo-partnership, association or corporation i-rho in the County )f Centra Costa, except upon horse races or contests of skill, speed or po!hrer r)f endurance -between horses actually occuring or to occur in the County (.)f Contra Costa and with- in a race track enclosure or fair ground in said County )f Centra Costa where said race or contest occurs, keeps any room, shed, tene- ment, booth or building, or any part thereof, or who keeps any place upon any public or private ground within said County of Contra Costa except as above provided, with any book, instrument or device for the purpose of recording or registering bets or wagers, or selling pools , or any persin, except as above provided, who records or reg- isters , or gagers or sells pools upon the result of any trial or con- test on- test of skill, speed or power of endurance of horses or, except as above provided, who receives or contracts t..) receive any money or representative of money, either as agent, carrier, commission broker, servant or employe, or in any representative capacity whatsoever fob' the purpose of making, placing, recording or registering any bet or wager or making any bet or pool upon the result of any trial or con- test of skill , speed or pourer of endurance of horses , or aho, except as provided above, recieve any money or representative of money in any capacity whateeever for the purpose «f being taken or sent to any fair or race track enclosure. either within or i.-ri thout this State where such contests of skill , speed, or power if endurance of horses are carried on, or to be taken or sent to any ether place to be reg-- istared, Dlaoed, wagered or bet at said fair or i�rithin said race track enclosure) or at any other place, upon the result of such c on- te s t of skill , apped or power of endurane a of such horses, then tak-- ing or thereafter to take place or to be thereafter carried on, or which is then being carried on, or which is alleged or reoreeneted to be then taking r)r thereafter to take place or to be thereaf ter carried on, or which has taken place or been already carried on, but the news of the result t-rhereolf has not yet been received or made knoilrn, or except as herein provided, being the oltirner, lessee or cus4a todian of any room, tenement, tent, booth, building, or any part thereof, knowingly permits the same to be used or occupied for any y of these pu . s , or, except as herein provided, therein keeps, exhibits or employs any device or apparatus for the purpose of recorrd#- Ing car registering such bets car iltragers or selling of such pools, or becomes the custodian or depositary of any money, property or thin g of value staked, wagered or pl edged un ren any result of such c e)n t e s t, or, except as herein orov id ed, who keeps ar exhibits or permits to be kept or exhibited P.ny device, appare.tus, blackboard, ps.per or lists whereon adds are written, printed car -oosfed, or vrhereon the names of horses or riders are printed or written, or who shall, except as herein provided sell, issue or dispose of any ticket, eert- if icate or other evidence of payment, or receipt for money to be placed , bet or wagered on such contest , ' �,.)r ur)on ilrhich shall be in- scribed, written or printed any numbers , name, word or mark or any thing to designate the choice selected, received or accepted by any other person to entitle or make the said person holding the said certificate or other evidence of payment or receipt to gain or lose on any contingent issue, or who, except as herein provided, shall receive any money or thing representing money or any articles of value as a bet or hazard upon the event ()f any contest or contingent issue or as a stake or pledge between two -)r moor a parties and di s- burse the said money, o,)r any thing representing money, 'r ether articles of value, upon any representation car conditions or in con- formity to or with any express or' tacit understanding or agreement , or 1.nrho, except as herein provided, shall allow or permit any minor to participate or be interested In any pool or book as aforesaid, or io be present at any time or place where the sale of pools, or the making of any book is being carried on or conducted or who shall purchase or acquire for money or any thing representing money, or r Ordinance No. 101 - Continued any article of value or any other consideration, any interest in or upon the event of any such triad, t--)r contest, or place or de'0 cis i t any stake, wager, hazard or pledge between tow or more parties, or any thing representing money, or any article of value, in or upon the happening of any such event or such trial or contest shall be deemed guilty ,;)f a misdemeanor, and upon a conviction thereof; shall be punished by a fine not exceeding five hundred 0500-00) dollars , or by imprisonment not exceeding six months, Or by both such fine and imprisonment. SECTION 2. Any person who shall visit or frequent any place the keening ur carrying on of iirhich in the County of Contra. Costa is made a misdemeanor by Section 1 of this Ordinance, shall be deemed guilty of a mi ademeanor and upon conviction thereof shall be punished by a fine n<)t exceeding three hundred (13000.00) Dollars , or by imprison- ment not exceeding three months, or by bath such fine and imprisonment SECTION 3. All Ordinances and parts of Ordinances in ct:)nflict with this Ordinance be and the same are hereby repealed. SECTION 4. Thi.s Ordinance shall take effect and be in force from and after its passage.
