HomeMy WebLinkAboutORDINANCES - 12151992 - 92-97 ORDINANCES OF THE BETHEL ISLAND (92- 97 ) , CONTRA COSTA COUNTY (92- 98 ) , EAST DIABLO (92- 99 ) , MORAGA (92300 ) , OAKLEY (92-101) , ORINDA (92-102 ) , RIVERVIEW (92-103 ) , AND WEST COUNTY (92-104) , FIRE PROTECTION DISTRICTS ADOPTING FEES FOR PERMITS, INSPECTIONS, PLAN-CHECKING AND OTHER SERVICES, AND REPEALING ORDINANCE NUMBERS 90-43' THROUGH 90-48 The Board of Supervisors of Contra Costa County, as and constituting the Board of Directors of the Bethel Island, Contra Costa County, East Diablo, Moraga, Oakley, Orinda, Riverview, and West County Fire Protection Districts, ordains as follows : Section I . Repeal. Except as herein provided, Ordinance Nos . 90-43 through 90-48 are hereby repealed. Section II . Authority. This ordinance is enacted, in part, pursuant to Health and Safety Code sections 13146 .2(b) , 13217(b) , 13869, 13871, 13916 and 17951, Government Code section 6103 .7 and article' ? (S 25120 et seq. ) , and the adopted provisions of the Uniform Fire Code Section III . Notice and Hearing. This ordinance was adopted pursuant to the procedures set forth in Government Code sections 66016, 66017 and 66018, and Health and Safety Code section 13916 , and all required notices have been properly given and public hearings held. Section IV. Permit, Inspection, Plan-Checking and Other Fees . Each person who applies for, requests or receives a permit, inspection, plan review or other service furnished by District shall, at the time of such application, request or receipt, pay the applicable fee or fees listed in Exhibit "A" attached to this Ordinance. As used in this Section, the term "person" means any natural person, firm, association, joint venture, joint stock company, partnership, organization, club, company, corporation, trust or other type of entity. Section V. Urgency Declaration. This ordinance is an urgency measure for the protection of the public health, safety and welfare as authorized by Government Code section 25122 . There is an urgent need for an increase in fees for permits, inspections, plan-review and other services provided by the District. The fees currently in effect do not reflect the cost to the District of the services provided. The existing fees are a current and immediate threat to the public health, safety and welfare because unless the fees are increased to reflect the actual cost to the District of providing these services, the ability of the District to provide these and other life preserving services will be curtailed. Section VI . Severability. If any fee or provision of this Ordinance is held invalid or unenforceable by a court of competent jurisdiction, that holding shall not affect the validity or enforceability of the remaining fees or provisions , and the Board declares that it would have adopted each part of this Ordinance irrespective of the validity of any other part. Section VII. Effective and Operative Dates . This ordinance is effective immediately upon passage, except that fees imposed on development projects become operative 60 days after passage, and the fees established by Ordinances Nos. 90-43 through 90-48 remain in effect until the corresponding fees in Exhibit "A" become operative pursuant to this ordinance or other urgency measure adopted by the Board. Section VIII . Publication. Within 15 days of passage, this ordinance shall be published once with the names of the Supervisors voting for and against it in the Contra Costa Times, a newspaper of general circulation published in this County.
