ORDINANCE NO. 89-11
Amendments To the Election Campaign Ordinance
The Contra Costa County Board of Supervisors ordains as follows
(omitting the parenthetical footnotes from the official text of
the enacted or amended provisions of the County Ordinance Code) :
SECTION I: SUMMARY. This ordinance (1 ) repeals Section 530-
2.402(b) of the County Ordinance Code authorizing additional in
kind contributions, (2) amends Section 530-2.402 of the County
Ordinance Code to increase the campaign contribution limit to one
thousand six hundred seventy-five dollars in an election cycle,
(3) amends Sections 530-2.404 and 530-2.216 of the County
Ordinance Code to comply with state law campaign contribution
limits for broad based political committees, but imposes a
$25,000 limit per election cycle on all such contributions, (4 )
adds a new subsection 10 to Section 530-2. 602 of the County
Ordinance Code to add a voluntary campaign expenditure limit of
$150,000 and renumbers the existing subsection 10 as 11; and, (5)
adds Section 530-2.603 of the County Ordinance Code to create
exemptions for the voluntary expenditure limit in the Candidate's
Fair Campaign pledge.
SECTION II: Section 530-2.402(b) of the County Ordinance Code is
repealed.
SECTION III: Section 530-2.402 of the County Ordinance Code is
amended to read:
In a single county election cycle, no person or
political committee (other than the candidate or a
broad based political committee) shall make, and no
candidate or campaign treasurer shall accept, any
contribution to or for a single candidate for county
office or to or for a committee authorized in writing
by the candidate to accept contributions for him, which
will cause the total amount contributed by such person
or political committee in support of that candidate to
exceed one thousand six hundred seventy-five dollars
($1,675) provided that in any calendar year in which
the candidate does not stand for election the maximum
permitted contribution shall be limited to two hundred
twenty-five dollars ($225) and in the calendar year in
which the candidate stands for election, the maximum
permitted contribution shall be five hundred dollars
($500) for the period from January 1 through June 30
and five hundred dollars ($500) for the period from
July 1 through December 31 of that year.
SECTION IV: Section 530-2 . 216 of the County Ordinance Code is
amended to read:
530-2. 216 Broad based political committee. "Broad
based political committee" shall have the same meaning
as Government code section 85102(d) . It means a
committee within the meaning of Government Code section
82013(a) which has been in existence for more than six
months receives contributions from one hundred or more
persons and acting in concert makes contributions to
five or more candidates . (Ord. 89-11 . )

' SECTION V: Section 530-2.404 of the County Ordinance Code is
amended to read:
530-2.404 Broad based political committees . In
any fiscal year, no broad based political committee
shall make, and no candidate or campaign treasurer
shall accept, any cash contribution to or for a single
candidate for county office or to or for a committee
authorized in writing by the candidate to accept
contributions for him, which will cause the total
amount contributed by such broad based committee in
support of that candidate during that fiscal year to
exceed five thousand dollars, provided, nevertheless,
that the total aggregate amount of contributions from
all broad based political committees which may be
accepted by. a single candidate in an election cycle-
shall not exceed twenty-five thousand dollars . (Ord.

SECTION VI: Section 530-2.602 of the County Ordinance Code is
amended to read:
530-2 .602 Pledge. The county clerk when he issues the
declaration of candidacy, shall also issue to each candidate
for county office, a form for a voluntary campaign pledge
which shall read as follows:
Fair Campaign Pledge
1 . I shall conduct my campaign for County Office
openly and fairly.
2 . I shall discuss the issues and participate in fair
debate with respect to my views and qualifications .
3 . I shall not engage in, or permit, defamatory
attacks on the character of my opponents; nor shall I engage
in unwarranted invasions of personal privacy unrelated to
campaign issues .
4 . I shall not at any time use or permit the use of
any campaign material or advertisement which misrepresents,
distorts, or otherwise falsifies the facts regarding any
candidate or the candidate's position on issues .
5 . I shall clearly identify myself, or my
campaign committee(s) , as the sender of all of my
campaign mailings .
6 . I shall personally approve in writing all of my
campaign material, advertisements, or mailings, prior to
their use.
7 . I shall publicly repudiate support derived from
any individual or group whose activities would violate this
Fair Campaign pledge.
B. I shall file all campaign statements as required
by the California Political Reform Act and the Contra Costa
County Election Campaign Ordinance, on time and with full
disclosure of campaign contributions and expenditures.
9 . I shall not duplicate or use any lists of
contributors filed by any other candidates for the purpose
of compiling my own mailing lists without the permission of
the other candidate.
10. 1 shall limit my campaign expenses in this
election to no more than $150,000 .

11 . I, the undersigned candidate for election to a
County Office in the County of Contra Costa, hereby
voluntarily endorse, subscribe to, and solemnly pledge
myself to conduct my campaign in accordance with the above
principles and practices .

SECTION VII : Section 530-2 . 603 of the County Ordinance Code is
added to read:
530-2 . 603 Exemptions from campaign expenditure limit.
Notwithstanding Section 53-2 . 602 10, any candidate who
voluntarily agrees to limit his campaign expenses shall
cease to be bound by the expenditure limit if (a) any other
candidate seeking the same office exceeds the $150,000
expenditure limit, regardless of whether such candidate has
agreed to observe the expenditure limit, or (b) any third
party committee, not controlled by a candidate in the same
election provides campaign funds to either oppose the
election of the candidate who voluntarily agrees to limit
his campaign expenditure, or to support the election of any
other candidate seeking the same office.
SECTION VIII : Effective Date. This ordinance becomes effective
30 days after passage, and within 15 days of passage shall be
published once with the names of the supervisors voting for and
against it in the Contra Costa Times, a newspaper published in
this County.
