Summary. This ordinance provides for an increase in the fees to be collected from developments within the boundaries of the Crow Canyon Road Extension Area of Benefit as originally established by County to fund the extension of Crow Canyon Road. SECTION II. Authority. This ordinance is enacted, in part, pursuant to the following authorities: (1) Resolution No. 86/36 (January 28, 1986) and Ordinance No. 86-11 (February 4, 1986) ; (2) the Reimbursement Agreement between Contra Costa County and Blackhawk Corporation dated September 16, 1986 (Resolution No. 86/560) ; (3) the Joint Exercise of Powers Agreement between Contra Costa County, the City of Danville and the City of San Ramon, dated February 10, 1987 (Resolution 87/70) ; (4) Resolution No. 87/510 (September 29, 1987) ; and (5) Government Code Sections 54986, 54992 and 65962 . SECTION III. Notice and Hearing. This ordinance was adopted pursuant to the procedures set forth in Government Code Sections 54986, 54992 and 65962, and all required notices have been properly given and public hearings held. SECTION IV. Fee Increase. Section IV of Ordinance No. 86-11 is amended to read as follows: Revised Fee Adoption: The following revised fees and fee schedule are hereby ADOPTED for the Crow Canyon Road Extension Area of Benefit to fund the road extension in accordance with Resolution No. 86/36 (January 28, 1986) , Ordinance No. 86-11 (February 4, 1986) , the Reimbursement Agreement between Contra Costa County and Blackhawk Croporation, dated September 16, 1986 (Resolution No. 86/560) , the Joint Exercise of Powers Agreement between Contra Costa County, the City of Danville and the City of San Ramon, dated February 10, 1987 (Resolution No. 87/70) , Resolution No. 87/510 and this Ordinance No. 87-71 (September 29, 1987) , and shall be LEVIED and COLLECTED pursuant to the above authorities; final fees subject to annual review of final costs and final approved entitlements in the Fee Benefit Area by Contra Costa County: Residential single family $1640/unit Residential multi-family $1312/unit Commercial $1.60/square foot of gross floor area Office $1.85/square foot of gross floor area SECTION V. Area of Benefit. The fees described in this ordinance shall apply to all property described in the Development Program Report dated January 28, 1986 (Approved by Resolution 86/36) and more particularly described in Exhibit "A" attached hereto. SECTION VI. Continued Effectiveness. Resolution No. 86/36 (January 28, 1986) , Ordinance No. 86-11 (February 4, 1986) as amended hereby, the Reimbursement Agreement between Contra Costa County and Blackhawk Corporation dated September 16, 1986 (Resolution No. 86/560) , the Joint Exercise of Powers Agreement i Page Two between Contra Costa County, the City of Danville and the City of San Ramon, dated February 10, 1987 (Resolution No. 87/70) , Resolution No. 87/510 (September 29, 1987) , and all actions taken in accordance with the foregoing authorities shall continue in full force and effect. SECTION VII. Severability. If any fee or provision of this Ordinance is held invalid or unenforceable by a court of competent jurisdiction,.. that holding shall not affect the validity or enforceability of the remaining fees or provisions, and the Board declares that it would have adopted each part of the Ordinance irrespective of the validity of any other part. SECTION VIII. Effective Date. This Ordinance shall become effective 60 days after passage and, within 15 days of passage, shall be published once with the names of the Supervisors voting for and against it in the Valley Pioneer, a newspaper of general circulation published in the County.
